No.3909 コンゴ:母娘をレイプし、その後母親を殺害した9人の兵士の内、5人が有罪判決を受けました。

 SOSトーチャー国際事務局は、コンゴにおける下記の状況に関して皆様の引き続きの働きかけをお願いします。

<新情報>

SOSトーチャー国際事務局は、南キヴ州のキチュラ村で13歳の少女がレイプされ、その母親のマレンガ・ラマザニさん(37歳)がレイプされて殺害され、性器が切断された事件の加害者として9人の兵士のうち4人が、ウヴィラ駐屯地の軍法会議によって有罪になったという情報を入手しました。

情報によると、2006年12月22日に開かれた公判は、出席した地元NGOによると国際的な中立原則に則っており、連隊上級曹長シャバニ・マネノおよび同連隊のアレクシス・マスンブコ、アルファニ・アルーチ、カタクワ・マシマンゴが、マレンガ・ラマザニさんに対するレイプ、殺害、性器切断と、13歳の少女のレイプについて有罪となりました。彼らは終身刑となり、降格になった上、軍隊を除名されました。シャバニ・マネノはさらに、少女とその家族に対し、1万ドルの損害賠償金の支払いを命じられました。

国際事務局は残る5人の兵士が国外に逃亡して処罰を受けていないことを憂慮し、コンゴ当局に対し、彼らが裁判に付されるよう、あらゆる必要な措置を講じるよう要請します。

13歳の少女はSOSトーチャー国際事務局の被害者緊急救援プログラムによる治療を受けています。2007年1月11日に退院することができました。

<事件の概要>

情報によると、2006年10月13日午後3時頃、マレンガ・ラマザニさんが娘とともに畑を耕していたところ、コンゴ軍の兵士5人に取り囲まれました。この5人は軍服を着ており、第118旅団に属する兵士たちでシャバニ・マネノという兵士が率いていました。兵士らは2人を脅し、未成年の娘をレイプした後、母親をエラフリ・ニクパという丘の上に連れていきました。彼女はそこで3日間にわたって9人の男にレイプされ、最後には怪我と痛みのために気を失いました。すると兵士らは彼女の性器を撃ち、そこを切り取り始めました。

少女は、兵士たちが母親に向かった時に逃げだして助けを求めることができました。後にFerufavide-Absl(南キヴの地元NGO)の専門チームがマレンガ・ラマザニさんの遺体を発見し、証拠を集めた後、家族の承諾を得て少女と母親の被害を関係司法当局に告発しました。複数の怪我をしていた少女はブルンジのブジュンブラの病院で婦人科と眼科の治療を受けましたが、治療費が不足して治療を受け続けることができませんでした。

SOSトーチャー国際事務局は、被害者のためにコンゴ当局に手紙を送り、加害者の逮捕を働きかけて下さった個人および団体の皆さまにお礼申し上げるとともに、この件に関して引き続きご支援をお願いします。

<行動要請>

 コンゴ関係当局に以下の内容の要請をお願いします。

1. 被害少女たちの心身の安全を保障するために必要な措置をすべて講じること。

2.責任者すべてを特定し、裁判に付し、法に基づき刑事罰を適用できるよう、この事件への綿密で  公正な調査を命じること。

3.拷問禁止委員会第35会期が出した勧告の実施を含み、国際法および国際人権基準に沿って、国内全土における人権尊重と基本的自由を保障すること。

I am writing you to express my deep concern over the case of rape of mother and her daughter and the subsequent murder of the mother by 9 soldiers on 13 October 2006, in Kichula, South Kivu. While I welcome the conviction of four military men out of nine, I would like to urge you the following.

1. To take all necessary measures to guarantee the physical and psychological integrity of the girl;

2. To order a thorough and impartial investigation into this case, in order to identify all those responsible, bring them to trial and apply the penal sanctions as provided by law;

3. To guarantee the respect for human rights and fundamental freedoms throughout the DRC in accordance with international law and human rights standards, including the implementation of the recommendations issued by the Committee against Torture at its 35th session.

Rape of a minor girl and her mother/ Torture, murder and mutilation of the mother/

Conviction of four of the accused/ Five other defendants gone into hiding

Geneva, 22 January 2007.

The International Secretariat of the World Organisation Against Torture (OMCT) has received new information and requests your urgent intervention in the following situation in Democratic Republic of the Congo (DRC).

New information:

The International Secretary of OMCT has been informed by reliable sources of the conviction, by the military tribunal under the military auditor of the garrison of Uvira, of four of the nine army members responsible for the rape, murder and genital mutilation of Mrs Malenga Ramazani and for the rape of her 13-year-old daughter, on 13 October 2006, in Kichula, South Kivu.

According to the information, on 22 December 2006, during a public hearing that according to the local NGOs present was conducted in conformity with international standards of impartiality, the Regimental Sergeant major Shabani Maneno and three of his troops Alexis Masumbuko, Alfani Alooci and Katakwa Mashimango were found guilty of the rape, mutilation and death of Ms Malenga Ramazani and of the rape of her 13-year-old daughter. They were sentenced to life imprisonment, degraded and expelled from the army. Shabani Maneno was further sentenced to pay a 10 000$ compensation to the girl and her family.

OMCT remains deeply concerned by the impunity of the remaining five army members responsible for these acts, who allegedly fled the DRC, and calls upon the Congolese authorities to undertake all necessary measures to ensure they will be brought to trial.

The 13-year-old girl has benefited from continued medical care through OMCT’s Urgent Assistance to Victims Programme. She was discharged from hospital on 11 January 2007.

Brief reminder of the situation:

On 13 October 2006, in a village of South Kivu, around 3 p.m., Mrs. Malenga Ramazani, 37 years of age, was hoeing in her field with her 13-year-old daughter, when five men belonging to the Congolese Army wearing uniform, led by Shabani Maneno of Brigade n° 118, encircled them. After threatening them, they raped the minor girl and took the mother to the top of the hill ≪ Elahuli n’icupa ≫. There she was raped repeatedly by 9 men during 3 days until she passed out due to the trauma and pain. Then they shot her in the vagina and started mutilating it before letting her die.

The minor girl succeeded to escape at the time they attacked her mother and called for help. The technical team of Ferufavide-Absl later found the corpse of Mrs Malenga Ramazani and, after gathering evidence, filed a complaint with the family’s authorisation before the competent jurisdiction for the violations perpetrated against the girl and her mother. Suffering from severe physical trauma, the girl was taken to Bujumbura (Burundi) for gynaecological and ophthalmologic care, but could not benefit from sustained medical care at that time due to a lack of financial means.

Remark:

The International Secretary of the OMCT wishes to thank all those individuals and organisations that have written to the Congolese authorities on behalf of the victims and requesting the arrest of those responsible, and calls for continued intervention in this case.

Actions requested:

Please write to the authorities in the Democratic Republic of the Congo urging them to:

i. Take all necessary measures to guarantee the physical and psychological integrity of the girl;

ii. Order a thorough and impartial investigation into this case, in order to identify all those responsible, bring them to trial and apply the penal sanctions as provided by law;

iii. Guarantee the respect for human rights and fundamental freedoms throughout the DRC in accordance with international law and human rights standards, including the implementation of the recommendations issued by the Committee against Torture at its 35th session (see item 12 regarding acts of violence against women, CAT/C/RDC/CO/1/CRP.1).
