No.4016 ケニア:人権・平和のためのNGOの連合体への弾圧が当局により検討されている模様です。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、ケニアにおける以下の状況に関して、皆様の緊急の働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構はケニア人権委員会(KHRC)元委員長でケニア全国人権委員会(KHRC)委員長のマイナ・キアイさんをはじめ、NGOの連合である「真実と正義にもとづいた平和のためのケニア・イニシアティブ(KPTJ) (1)」のメンバーが脅迫を受けているという情報を入手しました。

情報によると、2007年1月8日、ケニア警察と国家治安情報局の信頼できる情報筋がKPTJに対し、メンバーの身が安全ではないこと、そしてKPTJを「無力化する方法」を検討する特別部隊が結成されたと知らせてきました。また、夜間の運転には気をつけるようにとも警告してきました。

監視機構は、この脅迫を憂慮し、政治的緊張が高まる中で自由で公正な選挙の原則の実施(2)に取り組んでいるKHRCの活動を攻撃する狙いがあるのではないかと懸念します。

監視機構は、1998年 12月9日に国連総会が採択した人権擁護家に関する宣言の第12条2項「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」を想起します。

(1) KPTJは選挙の不正を告発し、ケニアにおける表現と結社の自由を促進するため、先の選挙の後に結成された。

(2) 2008年1月10日にKPTJは、ケニア選挙委員会(ECK)が総選挙の手続き、運営、管理において犯罪を行った(証明書偽造、職務怠慢、法的義務の不服従、司法もしくは行政書類の偽造など)として、告発状をキリマニ警察に提出する平和的な行進を行った。

<行動要請>

 ケニア関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうともKPTJのメンバーおよび国内のすべての人権擁護家の心身の安全を保障すること。

2.責任者を特定し、資格のある公正な文民裁判に付し、法に基づき刑事罰を適用できるよう、KPTJメンバーに対する脅しについて徹底的で公正な調査を命じること。

3.ケニアにおける人権擁護家に対するすべての嫌がらせ行為に終止符を打つこと。

4.1998年12月9日に国連総会が採択した国連人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を守ること。

5.さらには、国際人権基準およびケニアが批准した国際文書および地域文書に従って、国内全土における人権尊重と基本的自由を保障すること。

2. To order a thorough and impartial investigation into the threats against KPTJ members, in order to identify all those responsible, bring them before a civil competent and impartial tribunal and apply to them the penal sanctions provided by the law;
3. To put an end to all acts harassment against human rights defenders in Kenya;
4. To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly on December 9, 1998, especially its Article 1, which states that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels", as well as above-mentioned Article 12.2;
5. More generally, to ensure in all circumstances the respect for human rights and fundamental freedoms in accordance with international and regional human rights instruments ratified by Kenya.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), requests your urgent intervention in the following situation in Kenya.

Description of the situation:

The Observatory has been informed of threats against members of Kenyans for Peace with Truth and Justice Initiative (KPTJ), a coalition of independent NGOs[1], including Ms. Maina Kiai, former Chairman of the Kenya Human Rights Commission (KHRC) and Chair of the Kenya National Commission of Human Rights.

According to the information received, on January 8, 2007, reliable sources within the Kenyan Police Force and the National Security Intelligence Service informed KPTJ that the personal safety and security of its members was at risk and that a special unit had been formed to consider "methods of neutralisation" of the latter, who were also warned that they had to be cautious when driving at night.

The Observatory expresses its deep concern about these threats and fears that they might be aimed at striking down the activities of the KHRC and to intimidate its members, as the latter are struggling for the implementation of the principle of free and fair elections[2], in a context of increasing political tension.

The Observatory also recalls that according to Article 12.2 of the United Nations Declaration on Human Rights Defenders, adopted by the UN General Assembly on December 9, 1998, "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration".

Actions required:

Please write to the Kenyan authorities, urging them to:
i. Guarantee in all circumstances the physical and psychological integrity of KPTJ members and of all human rights defenders in the country;
ii. Order a thorough and impartial investigation into the threats against KPTJ members, in order to identify all those responsible, bring them before a civil competent and impartial tribunal and apply to them the penal sanctions provided by the law;
iii. Put an end to all acts harassment against human rights defenders in Kenya;
iv. Conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly on December 9, 1998, especially its Article 1, which states that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels", as well as above-mentioned Article 12.2;
v. More generally, ensure in all circumstances the respect for human rights and fundamental freedoms in accordance with international and regional human rights instruments ratified by Kenya.

[1] The KPTJ was formed in the aftermath of the immediate past general elections to denounce electoral frauds and to support freedom of expression and association in the country.
[2] On January 10, 2008, a peaceful march was organized by the KPTJ to Kilimani Police Station to file a private prosecution against the Electoral Commission of Kenya (ECK) with regard to criminal offenses (making of false certificates; neglect of duty; disobedience of statutory duty; forgery of judicial or official documents, etc.) committed in the processing, management and control of the general elections.
