No.4021  トルコ:人権擁護家が恣意的に逮捕されました。その活動に対する制裁と思えます。

「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、トルコにおける以下の状況に関して、皆様の緊急の働きかけをお願いします。

<事件の概要>

人権擁護家のための監視機構は人権協会(IHD)より、IHDアダナ支部長のエセム・アシカリンさんが恣意的に逮捕されたという情報を入手しました。

情報によると、エセム・アシカリンさんは2008年1月23日にアダナで逮捕され、「違法組織への所属」(トルコ法第5237号の刑法第220/6条に関連したトルコ刑法第314条)と「違法組織のプロパガンダ活動」(反テロ法第3713号の第7/2条)で起訴されました。

これらの嫌疑は、革命的人民解放党・戦線(DHKP-C)の党員であったケヴセル・ミズラックさんが2007年12月10日にアンカラ市で暗殺されたことに対して「アダナの権利と自由のための前線」が12月17日に開催した記者会見にエセム・アシカリンさんが参加したことに関連しています。この記者会見では、超法規的処刑を非難し、このような人権侵害を防止するよう治安部隊に呼びかける文章が読み上げられました。

現時点でアシカリンさんはアダナのFタイプ刑務所で拘禁されています。彼は、同じ2008年1月23日に逮捕されたほかの6人の抗議者と一緒にDHKP-Cの党員であるとして起訴され(トルコ刑法第314条にもとづく)、1年から7年半の禁固を科せられる可能性があります。

監視機構は、エセム・アシカリンさんの人権活動に制裁を与える狙いがあるとしか考えられない恣意的な逮捕に憂慮を表明します。トルコは欧州安全保障・協力機構(OSCE)加盟国として「国連人権擁護家の保護のための宣言は、国内および国際レベルでの人権と基本的自由の保護と実現に人権擁護家が取り組むことができるような環境を提供するよう、適切な法的および行政的手続きを採択し、実施する義務を国家に(課している)」を認め、「OSCE、その組織、現場活動および加盟国による人権擁護家に対する特別な注意、支援、保護の必要」を認識していることを指摘します(1)。

<行動要請>

 トルコ関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうとも、エセム・アシカリンさんの心身の安全を保障すること。

2.エセム・アシカリンさんの拘禁は彼の人権活動に対する制裁に思えるため、即時に彼を釈放すること。

3.エセム・アシカリンさんおよびトルコの人権擁護家に対する司法レベルも含めすべてのレベルでの嫌がらせを止めること。

4.1998年12月9日に国連総会が採択した国連人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を守ること。

5.さらには、いかなる情況にあろうとも、トルコが批准した地域および国際人権文書に沿って、国内における人権尊重と基本的自由を保障すること。

1. To guarantee in all circumstances the physical and psychological integrity of Mr. Ethem Ackaln;
2. To release immediately Mr. Ethem Ackaln, as his detention is arbitrary as it seems to merely aim at sanctioning his human rights activities;
3. To put an end to all acts harassment, including at the judicial level, against Mr. Ethem Ackaln and all human rights defenders in Turkey;

To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly on December 9, 1998, especially its Article 1, which states that “everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels”, as well as Article 12.2, which provides that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;
5. More generally, to ensure in all circumstances the respect for human rights and fundamental freedoms in accordance with international and regional human rights instruments ratified by Turkey.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Turkey.

Description of the situation:

The Observatory has been informed by the Human Rights Association (nsan Haklari Dernei - IHD) about the arbitrary arrest of Mr. Ethem Ackaln, Chairperson of the IHD branch in Adana.

According to the information received, on January 23, 2008, Mr. Ethem Ackaln was arrested in Adana and accused of "being a member of an illegal organisation" (Article 314 of the Turkish Penal Code, with reference to Article 220/6 of the Penal Code in the Turkish Law N° 5237) and "making propaganda of an illegal organisation" (Article 7/2 of the Anti Terror Law N° 3713).

These charges are related to Mr. Ethem Ackaln's participation in a press conference organised on December 17, 2007 by the Front for Rights and Freedoms of Adana (Adana Haklar ve Ozgurlukler Cephesi) in order to denounce the assassination on December 10, 2007 of Ms. Kevser Mzrak, reportedly a member of the Revolutionary People's Liberation Party/Front (Devrimci Halk Kurtulus Partisi - Cephesi - DHKP-C), in Ankara. Ms. Mzrak was allegedly killed by police forces. During the press conference, a document was read, denouncing extrajudicial executions and calling upon the security forces to prevent such human rights violations.

As of issuing this urgent appeal, Mr. Ackaln is detained at the F-Type Prison in Adana. He was accused of being a member of the DHKP-C (on the basis of Article 314 of the Turkish Penal Code), along with six other opponents who were also arrested on January 23, 2008, and faces from one to seven years and a half in prison.

The Observatory expresses its deepest concern about Mr. Ethem Ackaln's arbitrary detention, which seems to merely aim at sanctioning his human rights activities, and recalls that as a Participating State of the Organisation for Security and Cooperation in Europe (OSCE), Turkey acknowledges that "the [...] UN Declaration on Human Rights Defenders [... places] a responsibility [...] on states to adopt and implement adequate legislation and administrative procedures that would provide for a conducive environment for human rights defenders to promote and strive for the protection and realization of human rights and fundamental freedoms at the national and international levels", and recognises "the need for particular attention, support and protection for human rights defenders by the OSCE, its Institutions and field operations, as well as by participating States"[1].

Actions required:

Please write to the Turkish authorities, urging them to:

i. Guarantee in all circumstances the physical and psychological integrity of Mr. Ethem Ackaln;

ii. Release immediately Mr. Ethem Ackaln, as his detention is arbitrary as it seems to merely aim at sanctioning his human rights activities;

iii. Put an end to all acts harassment, including at the judicial level, against Mr. Ethem Ackaln and all human rights defenders in Turkey;

iv. Conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly on December 9, 1998, especially its Article 1, which states that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels", as well as Article 12.2, which provides that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
