No.4023 バングラデシュ:労働者の権利をモニターするNGOの活動家が当局による拘束をとかれました。

「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、バングラデシュにおける以下の状況に関して、皆様の引き続きの働きかけをお願いします。

<新情報>

人権擁護家のための監視機構はNGOのバングラデシュ人権ホットラインより,バングラデシュ市民で労働者権利コンソーシアム(WRC)の労働権調査官のメヘディ・ハサンさんが釈放されたという情報を入手しました。WRCは世界中の工場の労働条件を調査している独立の労働権監視団体です。

情報によると、2008年2月3日、メヘディ・ハサンさんは起訴されることなく釈放されたということです。体調はかなり悪化していて動けないため、今は自宅で静養しているということです。

監視機構はメヘディ・ハサンさんの釈放を歓迎し、彼のために行動して下さった個人および団体の皆様にお礼を申し上げます。

<背景情報>

メヘディ・ハサンさんはWRC東南アジア担当フィールドディレクターでデンマーク人のベント・ゲールトさんとバングラデシュの監視活動を行っていましたが、2008年1月24日にダッカでバングラデシュ情報機関に逮捕されました。彼は最初グルシャンの国家治安情報事務所に連行され、次にパラビ警察に移送されました。2008年1月25日に「さらに尋問するため」として引き続き4日間警察で拘束されることになりました。2008年2月3日に釈放されるまで、彼に関してそれ以上の情報は得られませんでした。

同じ日、居住地であるタイに帰ろうとしていたゲールトさんはダッカ空港で逮捕され、尋問を受けました。尋問は1時間ほど行われ、ゲールトさんとハサンさんがここ数週間にわたってバングラデシュで行っていた活動を説明するよう言われたということです。尋問官の質問から、バングラデシュ当局はこの2人の人権擁護家のバングラデシュでの活動を知っていることがうかがえました。

<行動要請>

 バングラデシュ関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうとも、メヘディ・ハサンさんとベント・ゲールトさんの心身の安全を保障するための必要な措置をすべてとること。

2.バングラデシュのすべての人権擁護家に対する嫌がらせ行為に終止符を打つこと。

3.1998年12月9日国連総会が採択した人権擁護家に関する宣言のすべての条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項に従うこと。

4.世界人権宣言およびバングラデシュが批准したすべての国際文書に沿って、国内全土における人権尊重と基本的自由を保障すること。

I am writing you to express my concern over the situation of Messrs. Mehedi Hasan and Bent Gehrt of an independent labour rights monitoring organization. I would like to urge you the followings:

1. To take all necessary measures to guarantee, in all circumstances, the physical and psychological integrity of Messrs. Mehedi Hasan and Bent Gehrt;
2. To put an end to all acts of harassment against all human rights defenders in Bangladesh;
3. To comply with the provisions of the Declaration on Human Rights Defenders adopted by the UN General Assembly on December 9, 1998, in particular Article 1, which states that "everyone has the right, individually or collectively, to promote the protection and fulfilment of human rights and fundamental freedoms at the national and international levels", Article 6 ("as well as article 12.2, which provides that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
4. To guarantee the respect of human rights and fundamental freedoms in accordance with the Universal Declaration on Human Rights and other international human rights instruments ratified by Bangladesh.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), has received new information and requests your urgent intervention in the following situation in Bangladesh.

New information:

The Observatory has been informed by the NGO Hotline Human Rights - Bangladesh about the release of Mr. Mehedi Hasan, a Bangladeshi citizen and a labour rights investigator for the Workers Rights Consortium (WRC), an independent labour rights monitoring organisation that carries out investigations of working conditions in factories worldwide.

According to the information received, on February 3, 2008, Mr. Mehedi Hasan was released, with no charge held against him. As he is quite sick and physically not able to move, he is currently resting at home.

The Observatory welcomes Mr. Mehedi Hasan's release and wishes to thank all the persons, organisations, and institutions that intervened in his favour.

Background information:

On January 24, 2008, Mr. Mehedi Hasan was arrested in Dhaka by the Bangladesh Intelligence Service, after carrying out a monitoring mission in Bangladesh along with Mr. Bent Gehrt, WRC South East Asia Field Director and a Danish national. He was first brought to the National Security Intelligence office in Gulshan, before being transferred to Pallabi police station. On January 25, 2008, Mr. Hasan was remanded to police custody for four additional days, for purposes of "further interrogation". No further information could be obtained before his release, on February 3, 2008.

On the same day, Mr. Gehrt was arrested and interrogated at the Dhaka airport, as he was about to board onto a plane to Thailand, where he lives. The interrogation lasted about an hour, during which Mr. Bent was asked to provide explanations on the activities he and Mr. Hasan had carried out in Bangladesh over the past weeks. The type of questions raised by the interrogators showed that the Bangladeshi authorities were aware of the actions undertaken by the two defenders in the country.

Actions requested:

Please write to the Bangladeshi authorities urging them to :
i. take all necessary measures to guarantee, in all circumstances, the physical and psychological integrity of Messrs. Mehedi Hasan and Bent Gehrt;
ii. put an end to all acts of harassment against all human rights defenders in Bangladesh;
iii. comply with the provisions of the Declaration on Human Rights Defenders adopted by the UN General Assembly on December 9, 1998, in particular Article 1, which states that "everyone has the right, individually or collectively, to promote the protection and fulfilment of human rights and fundamental freedoms at the national and international levels", Article 6 ("as well as article 12.2, which provides that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
