No. 4029 インド:ビルマとの国境近くに住む青年が買い物途中に強制失踪しました。

SOSトーチャー国際事務局はインドにおける以下の状況に関して皆様の緊急の働きかけをお願いします。 

<事件の概要>

SOS トーチャー国際事務局はSOSトーチャーネットワークメンバーである組織研究教育センター(CORE)より、マニプール市セナパティ郡ウラン・チル村在住のアビ・チルさん(18歳)が2008年1月27日から強制失踪しているという情報を入手しました。

情報によると、2008年1月27日午後3時頃、アビ・チルさんとおじのヌンシパさんがインドとビルマの国境のモレー門を通過しようとしたところ、モレー駐屯のアッサム・ライフルズ第24部隊に逮捕されたということです。2人はモレーに買い物に行ったということです。逮捕の理由は今のところ不明です。

ヌンシパさんは短い尋問の後、釈放されましたが、アビ・チルさんはそのまま拘禁されました。ヌンシパさんは帰宅し、アビ・チルさんの家族に逮捕のことを知らせました。家族はある団体とともに彼の捜索を始め、モレー警察や軍にも問い合わせをしましたが、何も得られませんでした。以来、アビ・チルさんの行方は分かりません。

国際事務局は、行方不明のアビ・チルさんが虐待や拷問を受けたり、超法規的に処刑されているおそれがあるとして、彼の心身の安全を深刻に懸念します。国際事務局は当局に対し、彼の行方をすぐに突き止め、いついかなる時も心身の安全を保障するよう要請します。

<行動要請>

 インド関係当局に以下の内容の要請をお願いします。

1.アビ・チルさんの所在を直ちに探しだし、いかなる情況にあろうとも心身の安全を保障すること。

2.正当な嫌疑が不在の中、彼を直ちに釈放するように命じること。そしてもそのような嫌疑が存在するならば、彼を迅速で公正な裁判に付し、その間の手続き上の権利を保障すること。

3.責任者を特定し、裁判に付し、法律に基づいて刑事あるいは行政罰を適用できるよう、これら一連の事件について徹底的で公正な調査を命じること。

4.国内法および国際人権基準に沿って、国内における人権尊重と基本的自由を保障すること。

4. To ensure respect for human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standard.

Arbitrary arrest/ Forced disappearance/ Fear for safety
The International Secretariat of the World Organisation Against Torture (OMCT) requests your URGENT intervention in the following situation in India.

Brief description of the situation

The International Secretariat of OMCT has been informed by the Centre for Organisation Research & Education (CORE), a member of OMCT SOS-Torture network, of the forced disappearance of Mr. Abi Chiru, 18-year-old, resident of Uran Chiru Village, Senapati District, in Manipur since 27 January 2008.

According to the information received, on 27 January 2008 at around 3:00 p.m., Mr. Abi Chiru was arrested along with his uncle, Mr. Nungshipa, by personnel of the 24th BN, Assam Rifles stationed at Moreh, when they were trying to enter Moreh Gate No.2, at the Indo-Myanmar border. Both had reportedly gone to Moreh for shopping. The reasons of their arrest remain as of now unclear.

While Mr. Nungshipa was subsequently released after a brief interrogation, Mr. Abi Chiru was allegedly detained. Mr. Nungshipa reportedly got home and informed Mr. Abi Chiru's family of his arrest. His family along with an organisation started searching for him and inquired before the Moreh Police and some army officials but without success. Mr. Abi Chiru's whereabouts remain since then unknown.

The International Secretariat of OMCT is gravely concerned for the physical and psychological integrity of Mr. Abi Chiru, as his whereabouts remain unknown, giving rise to fears that he may be subjected to ill-treatment, torture or potentially extra-judicial execution. OMCT calls on the authorities to immediately locate his whereabouts and guarantee his personal integrity at all times.

Action requested

Please write to the authorities in India urging them to:

i. Immediately locate the whereabouts of Mr. Abi Chiru and guarantee, in all circumstances, his physical and psychological integrity;
ii. Order his immediate release in the absence of valid legal charges, and if such charges exist, ensure that he is given a prompt and fair trial, in which his procedural rights are guaranteed at all times;
iii. Order a thorough and impartial investigation into these events in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
iv. Ensure respect for human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standard.
