No.4037 トルコ:人権協会の理事が人権活動の制裁としか思えない嫌がらせを受けつづけています。

(ジュネーブ・パリ発 3月18日)

「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、トルコにおける以下の状況に関して、皆様の引き続きの働きかけをお願いします。

<新情報>

人権擁護家のための監視機構は人権協会(IHD)より、IHD本部の理事であり、IHDビンギョル支部の元支部長のリドヴァン・キズギンさんに対する司法的嫌がらせが続いているという情報を入手しました。

情報によると、2005年10月7日にビンギョル第2裁判所がキズギンさんに言い渡した禁錮2年6ヶ月の有罪判決を、2008年3月3日に控訴裁判所が認めたということです(1)。有罪判決は、2003年にビンギョルのある村で5人が殺害された事件についてキズギンさんがレポートを発表したことに関連しています。

キズギンさんは現在ビンギョル拘置所で拘禁されています。

監視機構は、他にも「国家機関に対する侮辱」、「トルコの独自性に対する侮辱」、トルコ刑法第301条違反に関してキズギンさんが訴えられた2つのケースが控訴裁判所で係争中だという情報を得ています。

1つ目のケースは、ビンギョルでのレイプ事件に関するキズギンさんのプレスリリースに関するものです。2007年5月22日に、キズギンさんはビンギョル第2刑事裁判所で禁錮6ヶ月、罰金570新トルコリラの判決を受けています。彼は控訴を行い、ケースは現在係争中です。

2つ目のケースは、2006年11月14日にキズギンさんとIHD副会長のキラズ・ビシシさんが(2)「トルコのアイデンティティを侮辱した(3)」として禁錮5ヶ月の判決を受けた件です。この判決は後に罰金1750新トルコリラに変わりました。2人とも控訴を行い、現在係争中です。

監視機構は、人権活動に制裁を与える狙いがあるとしか考えられないキズギンさんに対する司法的嫌がらせと恣意的拘禁を憂慮します。これは、トルコで人権擁護家に対する嫌がらせと司法手続きが続いている中で起きています。

監視機構は、トルコ当局に対し、「人権擁護家に関する欧州評議会閣僚委員会宣言」を遵守して人権擁護家のための環境をつくり、人権擁護家を保護、その活動を促進、尊重するような効果的な措置を講じ、人権擁護家が効果的な補償を受けられるようにし、人権擁護家に対する嫌がらせや襲撃を防止するための行動をとり、人権擁護家の欧州人権裁判所へのアクセスを保障するよう要請します。

トルコは欧州安全保障・協力機構(OSCE)加盟国として「国連人権擁護家の保護のための宣言は、国内および国際レベルでの人権と基本的自由の保護と実現に人権擁護家が取り組むことができるような環境を提供するよう、適切な法的および行政的手続きを採択し、実施する義務を国家に(課している)」を認め、「OSCE、その組織、現場活動および加盟国による人権擁護家に対する特別な注意、支援、保護の必要」を認識していることを指摘します(4)

(3) ビンギョル警察署長によるキズギンさんに対する嫌がらせ行為を非難する記事をビシシさんが発表したところ、2人は起訴された。

<行動要請>

 トルコ関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうともキラズ・ビシシさんの心身の安全を保障すること。

2.彼の拘束は彼の人権活動に対する制裁にしか思えないため恣意的である。彼を即時無条件で釈放すること。

3.キラズ・ビシシさんおよびトルコのすべての人権擁護家に対する司法レベルも含めたすべての嫌がらせ行為を停止すること。

4.1998年12月9日国連総会が採択した人権擁護家に関する宣言の条文、とりわけ、すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を守ること。

5.さらには、トルコが批准した国際および地域文書に沿って、国内全土における人権尊重と基本的自由を守ること。

1. To guarantee in all circumstances the physical and psychological integrity of Mr. Ridvan Kizgin ;

To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly on December 9, 1998, especially its Article 1, which states that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels", as well as Article 12.2, which provides that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
5. More generally, to ensure in all circumstances the respect for human rights and fundamental freedoms in accordance with international and regional human rights instruments ratified by Turkey.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), has received new information and requests your urgent intervention in the following situation in Turkey.

New information:

The Observatory has been informed by the Human Rights Association (nsan Haklari Dernei - IHD) about the ongoing judicial harassment against Mr. Ridvan Kizgin, board member of the IHD headquarter office and former Chairperson of the Bringol Branch of IHD.

According to the information received, on March 3, 2008, the Yargitary (Appeal Court) upheld a decision of the Bingol 2 Criminal Court, which had sentenced Mr. Kizgin to two years and six months of imprisonment on October 7, 2005[1]. This sentence had been issued following the release by Mr. Kizgin of a report in which he denounced the killing of five persons in a village in Bingol in 2003.

Mr. Kizgin is currently detained in Bingol detention centre.

The Observatory was further informed of two other cases against him that are pending before the Appeal Court for "insulting a State agent" as well as for "insulting Turkishness" and violating Article 301 of the Turkish Penal Code.

The first case is related to the denunciation by Mr. Kizgin of a case of rape in Bangol through the publication of a press release. On May 22, 2007, Mr. Kizgin had already been sentenced to six months' imprisonment and 570 YTL by the Bingol 2 Criminal court. He had appealed this sentencing and the case is still pending.

The second case relates to the sentencing on November 14, 2006 of Mr. Kizgin and Ms. Kiraz Bicici, IHD Vice-president[2], to five months' imprisonment, for "denigrating Turkish identity"[3]. The sentence was later turned into a 1750 YTL fine. Both had appealed this sentencing, and the case is still pending.

The Observatory expresses its deepest concerns about the ongoing judicial harassment as well as the arbitrary detention of Mr. Kizgin, which seems to merely aim at sanctioning his human rights activities, in a context of increasing harassment and judicial proceedings against human rights defenders in Turkey.
The Observatory urges the Turkish authorities to conform to the Declaration of the Committee of Ministers of the Council of Europe on Human Rights Defenders, so as to create an environment conductive to human rights defenders, to take effective measures to protect, promote, and respect them, to ensure their access to effective remedies, to take action to prevent attacks and harassment against them, and to ensure their effective access to the European Court of Human Rights.

The Observatory further recalls that as a Participating State of the Organisation for Security and Cooperation in Europe (OSCE), Turkey acknowledges that "the [...] UN Declaration on Human Rights Defenders [... places] a responsibility [...] on states to adopt and implement adequate legislation and administrative procedures that would provide for a conducive environment for human rights defenders to promote and strive for the protection and realization of human rights and fundamental freedoms at the national and international levels", and recognises "the need for particular attention, support and protection for human rights defenders by the OSCE, its Institutions and field operations, as well as by participating States"[4].

Actions required:

Please write to the Turkish authorities, urging them to:
i. Guarantee in all circumstances the physical and psychological integrity of Mr. Ridvan Kizgin ;

ii. Release Mr. Ridvan Kizgin immediately and unconditionally, as his detention is arbitrary since it seems to merely aim at sanctioning his human rights activities ;

iii. Put an end to all acts harassment, including at the judicial level, against Mr. Ridvan Kizgin and all human rights defenders in Turkey;

iv.
