No.4055 スーダン:学生であり政治団体のメンバーの男性が拘束され拷問を受けました。

 SOSトーチャー国際事務局はスーダンにおける以下の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

 SOSトーチャー国際事務局はSOSトーチャーネットワークメンバーであるスーダン反拷問機構(SOAT)より、アルバハール・アルアマール大学の学生でありポートスーダンにある民主戦線と呼ばれている政治団体のメンバーであるファリス・アブド・アルハイ・モハメッド・アリさん(25歳)が、拷問と虐待を受けたという情報を入手しました。

 入手した情報によると、2008年5月11日午後3時、国家安全情報機関(NISS)のメンバーが、紅海州のポートスーダン病院の入口でファリス・アブド・アルハイ・モハメッド・アリさんを拘束しました。大学で学生間に衝突が起きたあと、ファリス・アブド・アルハイ・モハメッド・アリさんは負傷者を病院に運んでいた途中でした。

 逮捕後、ファリス・アブドゥ・アルハイ・モハメッド・アリさんは施設に連行され、拘禁中にブーツで蹴られたりキセルで打たれるなど、身体的な虐待を受けたと言われています。彼はアルバハール・アルアマール大学でのいかなる政治活動にも参加しないとの念書に無理やり署名させられたとも言われています。2008年5月12日午前3時に解放される前、情報機関のメンバーはファリス・アブド・アルハイ・モハメッド・アリさんに、もう一度拘禁されたら拘禁期間はより長くなるぞと言ったそうです。

 国家治安部隊法の下、NISSのメンバーは起訴することなく最大9ヶ月もの間人々を逮捕・拘禁する権限を許されています。同法はまた、NISSのメンバーを民事または刑事手続にかけるには、NISSの長官の事前の承認をえなければならないと規定しています。実際この規定により、拘禁中の拷問や虐待の責任者は処罰されてきませんでした。

 また入手した情報によると、数は不明ながら、学生たちがアルバハール・アルアマール大学での衝突の後逮捕されました。政治団体による大学での暴力行為はスーダンでよく発生しています。

 SOSトーチャー国際事務局は治安部隊による拷問や虐待の申し立てを深く懸念し、スーダン当局がファリス・アブド・アルハイ・モハメッド・アリさんの心身の安全を保障するよう要請します。事務局はまた、スーダンが残虐、非人道的または品位を傷つける取り扱いを禁止する「市民的及び政治的権利に関する国際規約 (ICCPR)」の締約国であること、拷問および不当な処遇の申し立てを熱心に検討し徹底した調査を行うことはスーダン当局の義務であることを指摘します。

<行動要請>

 スーダン関係当局に以下の内容の要請をお願いします。

1.ファリス・アブド・アルハイ・モハメッド・アリさんと、アルバハール・アルアマール大学における衝突の後に拘束されたその他の被拘禁者の心身の安全を保障すること。

2.責任者すべてを特定し、裁判に付し、法に基づいて刑事あるいは行政罰を適用できるよう、これら一連の事件、とりわけ拷問と虐待について、徹底的で公正な調査を命じること。

3.被害者に対する適切な補償を保障すること。

4.国内法、国際人道法および人権基準に沿って、国内全土における人権尊重と基本的自由を保障すること。とりわけ、スーダン国内の司法制度およびすべての法律が、スーダン暫定憲法および国際人権基準に準ずるように改革を急ぎ、国家公務員の免責に終止符を打つこと。

1. To guarantee the physical and psychological integrity of Mr. Faries Abd Alhay Mohmed Ali and the others detained following the clashes at al-Bahr al-Ahmar University;
2. To order a thorough and impartial investigation into these events, in particular into the allegations of torture and ill-treatment, in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
3. To guarantee that adequate compensation is awarded to the victim;
4. To guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international humanitarian law and human rights standards, and in particular, expedite reforms to bring the Sudanese justice system and all legislation into line with the Interim National Constitution and international human rights standards, and to end the impunity of state officials.

Alleged torture and ill-treatment/ Fear for safety

The International Secretariat of the World Organisation Against Torture (OMCT) requests your URGENT intervention in the following situation in Sudan.

Brief description of the situation

The International Secretariat of OMCT has been informed by the Sudan Organisation Against Torture (SOAT), a member of OMCT SOS-Torture network, about the alleged torture and ill-treatment suffered by Mr. Faries Abd Alhay Mohmed Ali, 25 years old student of al-Bahr al-Ahmar University and member of a student political body called the Democratic Front, in Port Sudan.

According to the information received, on 11 May 2008 at 3pm, members of the National Security and Intelligence Service (NISS) detained Mr. Faries Abd Alhay Mohmed Ali from the gates of Port Sudan Hospital, in Red Sea State. Following clashes between students at the university, Mr. Faries Abd Alhay Mohmed Ali had been taking wounded individuals to the hospital for treatment.

After his arrest, Mr. Faries Abd Alhay Mohmed Ali was taken to security premises and allegedly subjected to physical abuse in custody, including being kicked with boots and beaten with water pipes. Mr. Faries Abd Alhay Mohmed Ali was then reportedly forced to sign a written undertaking not to take part in any political activities at al-Bahr al-Ahmar University. Before releasing him at 3am on 12 May 2008, security agents allegedly told Mr. Faries Abd Alhay Mohmed Ali that, if he was detained again, it would be for much longer.

Under the National Security Forces Act, members of the NISS have the power to arrest and detain individuals without charge for up to nine months. The same act also dictates that the director of the NISS must give his prior approval in order for any security agent to face civil or criminal proceedings. In practice, this ensures the impunity of security agents responsible for torture and other abuses in custody.

According to the same information, an unknown number of students were arrested following the unrest at al-Bahr al-Ahmar University. Political violence on university campuses is a frequent occurrence in Sudan.

The International Secretariat of OMCT expresses its grave concern about the allegations of torture and ill-treatment by security forces and urges the Sudanese authorities to guarantee the physical and psychological integrity of Mr. Faries Abd Alhay Mohmed Ali at all times. OMCT recalls that Sudan is a State party to the International Covenant on Civil and Political Rights (ICCPR), which prohibits cruel, inhuman or degrading treatment. In line with their obligations under this treaty, it is incumbent on the Sudanese authorities to consider seriously any allegations of torture and ill-treatment, and to undertake a thorough investigation in this regard.

Requested Action

Please write to the authorities in Sudan urging them to:

i. Guarantee the physical and psychological integrity of Mr. Faries Abd Alhay Mohmed Ali and the others detained following the clashes at al-Bahr al-Ahmar University;
ii. Order a thorough and impartial investigation into these events, in particular into the allegations of torture and ill-treatment, in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
iii. Guarantee that adequate compensation is awarded to the victim;
iv. Guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international humanitarian law and human rights standards, and in particular, expedite reforms to bring the Sudanese justice system and all legislation into line with the Interim National Constitution and international human rights standards, and to end the impunity of state officials.
