No.4056 フィリピン:民族民主戦線(NDF)の対政府和平交渉の相談役の人が消息を絶っています。

 SOSトーチャー国際事務局はフィリピンにおける以下の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

 SOSトーチャー国際事務局は、SOSトーチャーネットワークメンバーである人民の権利の促進のための連合(KARAPATAN)より、サン・パブロ・イサベラにあるミナンガ・ノルテの住民であり、北部フィリピン、カガヤン渓谷で民族民主戦線(NDF)の和平交渉の相談役を務めているランディ・フェリックス・P・マラヤオさん(39歳)が2008年5月15日以来、失踪しているという情報を受けました。

 情報によれば、5月15日午後8時頃、ランディ・フェリックス・P・マラヤオさんはオルティガスの食堂で友人たちと夕食をとっていました。その一部始終を3人の男たちが監視していたと言われています(報告によれば3人ともクルーカットの短髪で、無線機をもっていたそうです)。その内の1人は、監視中に「はい、了解しました」というような言葉を発していたそうです。

 それから夜9時頃、ランディ・フェリックス・P・マラヤオさんはタクシーに乗り、パシグにある親戚のところに行きました。車中から彼は友人に、「今親戚の家に向かっているが、パシグのロサリオあたりで渋滞に会っている」という携帯メールを送ったといわれています。直後の9時17分、再び友人に「誰かにつけられている」というメッセージを送ったそうです。マラヤノさんはそれ以来消息を絶ちました。彼の親戚は何度も彼に電話をかけましたが、つながりませんでした。

 同じ情報によれば、数週間前に、フィリピン陸軍第5歩兵師団の将校が、イサベラ州カウアヤン市のボンボラジオ局を通して、「マラヤオが我らの手に落ちるのは時間の問題だ」と豪語したと伝えられています。マラヤノさんはカガヤン地方選出の下院議員ロドルフォ・アギナルドさん殺害の共同容疑者として、2003年名前をリストに載せられたといわれています。

 国際事務局は、ランディ・フェリックス・P・マラヤオさんが消息不明であり、もしかすれば虐待や拷問を受けているかもしれないし、悪くすれば超法規的処刑の可能性もあるとして、彼の心身の安全について深く憂慮します。国際事務局は当局に彼の所在を速やかに探し出し、どのようなときも彼の安全を保障するよう要請します。

<行動要請>

 フィリピン関係当局に以下の内容の要請をお願いします。

1.ランディ・フェリックス・P・マラヤオさんの行方を直ちに探し出すこと。

2.彼の心身の安全を保障するために必要な措置をすべてとること。

3.国際法および国際基準に合致しない正当な嫌疑が不在の中、彼の即時の釈放を命じること。もしそのような嫌疑が存在するならば、彼を公正で資格のある裁判に付し、その間、彼の手続き上の権利をすべて保障すること。

4.責任者を特定し、裁判に付し、法に基づいて刑事あるいは行政罰を適用できるよう、これら一連の事件について徹底的で公正な調査を命じること。

5.国内法および国際人権基準に従って、国内全土における人権尊重と基本的自由を保障すること。

2. To take all measures necessary to guarantee his physical and psychological integrity;
3. To order his immediate release in the absence of valid legal charges that are consistent with international law and standards, or, if such charges exist, bring him before an impartial and competent tribunal and guarantee his procedural rights at all times;
4. To order a thorough and impartial investigation into these events, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
5. To guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.

Forced disappearance/ Fear for safety

The International Secretariat of the World Organisation Against Torture (OMCT) requests your URGENT intervention in the following situation in the Philippines.

Brief description of the situation

The International Secretariat of OMCT has been informed by Alliance for the Advancement of Peoples' Rights (KARAPATAN), a member of OMCT SOS-Torture network, about the forced disappearance of 39 years old Mr. Randy Felix P. Malayao, resident of Minanga Norte, San Pablo Isabela and peace consultant for the National Democratic Front of the Philippines in Cagayan Valley in Northern Philippines, since 15 May 2008.

According to the information received, on 15 May 2008, at around 8am, Mr. Randy Felix P. Malayao was having dinner with his friends at a restaurant in Ortigas when they noticed three men, who were allegedly suspiciously looking at them (all three men were reportedly with crew cuts and communication equipments). One of the men reportedly said "positive sir", while still looking at them.

Later on, at around 9pm, Mr. Randy Felix P. Malayao reportedly boarded a taxi to visit his relatives in Pasig. He reportedly sent a text message to his friends informing that he was somewhere in Rosario, Pasig, stuck in traffic, on his way to his relatives' house. At 9:17pm another message followed in which he allegedly stated that he was being followed. Mr. Malayao has since then disappeared. His relatives tried several times to call him but to no avail.

According to the same information, several weeks ago, officers of the 5th Infantry Division of the Philippine Army allegedly bragged over local radio station Bombo Radyo in Cauayan City in Isabela that it was only a matter of time when Malayao would fall into their hands. Mr. Malayao was reportedly listed in 2003 as a co-accused in the killing of martial law henchman Cagayan Congressman Rodolfo Aguinaldo. Mr. Malayao has reportedly denied his involvement.

The International Secretariat of OMCT is gravely concerned for the physical and psychological integrity of Mr. Randy Felix P. Malayao, as his whereabouts remain unknown, giving rise to fears that he may be subjected to ill-treatment, torture or potentially extra-judicial execution. OMCT calls on the authorities to immediately locate his whereabouts and guarantee his personal integrity at all times.

Action requested

Please write to the authorities in the Philippines urging them to:

i. Immediately locate Mr. Randy Felix P. Malayao's whereabouts;
ii. Take all measures necessary to guarantee his physical and psychological integrity;
iii. Order his immediate release in the absence of valid legal charges that are consistent with international law and standards, or, if such charges exist, bring him before an impartial and competent tribunal and guarantee his procedural rights at all times;
iv. Order a thorough and impartial investigation into these events, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
v. Guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
