No.4057 中国:チベットに関する要求を平和的に掲げた僧侶2人が逮捕、拘禁されました。

 SOSトーチャー国際事務局は中国における以下の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

 SOSトーチャー国際事務局はSOSトーチャーネットワークメンバーであるチベット人権民主センター(TCHRD)より四川省甘孜県のチベット自治区で2人の僧侶、ジャンパ・ラーモさん(30歳、サドゥル村出身)とリンジン・ワンドンさん(23歳、ラリンヤン村出身)が逮捕されたという情報を入手しました。

 情報によると、2008年5月23日ジャンパ・ラーモさんとリンジン・ワンドンさんは甘孜県の県庁舎前で平和的な抗議活動を行い、「ダライ・ラマのチベットへの即時帰還」、「ダライ・ラマの長寿」、「チベットの自由」、「全政治犯の即時解放」を求めるスローガンを繰り返し叫びました。2人の僧侶は尋問のために公安(PSB)の拘禁施設に連行される前、公安職員にひどく殴られたということです。現在、彼らの状況について何の情報もありません。

 SOSトーチャー国際事務局は、表現、結社、集会の自由の平和的行使をしたことで逮捕・拘禁されたジャンパ・ラーモさんとリンジン・ワンドンさんの安全を深く憂慮します。さらに、国際事務局は2人が拷問や虐待を受ける可能性について危惧しています。国際事務局は中国が拷問及びその他の残虐で非人道的な又は品位を傷つける取り扱いを禁じる「国連拷問等禁止条約」の締約国であることを指摘します。国際事務局は当局が中国の国際人権法上の義務と国連人権理事会の理事国として選出されたときに行った公約を果たすよう要請します。

<行動要請>

 中国関係当局に以下の内容の要請をお願いします。

1. いかなる情況にあろうとも、ジャンパ・ラーモさんとリンジン・ワンドンさんの心身の安全を保障すること。

2. 彼らが無条件で家族や弁護士と面会でき、必要な医療を受けられるよう保障すること。

3. 正当な嫌疑が不在の中、2人の即時釈放を命じること。もしそのような嫌疑が存在するならば、彼らを公平で資格のある裁判に付し、その間の手続き上の権利を保障すること。

4. これら事件の責任者すべてを特定し、裁判に付し、法に基づき刑事あるいは行政罰を適用できるよう、これら事件の徹底的で公平な調査を命じること。

5. 国内法および国際人権基準に沿って、国内全土における人権尊重と基本的自由を守ること。

Dear Prime Minister Wen Jiabao,

I am writing you to express my concern over the arbitrary arrest and detention of Ven. Jampa Lhamo and Ven. Rinzin Wangdon in Kardze Tibet Autonomous Prefecture of Sichuan Province. I would like to urge you the followings:

1. To guarantee, in all circumstances, the physical and psychological integrity of Ven. Jampa Lhamo and Ven. Rinzin Wangdon;
2. To guarantee immediate and unconditional access to legal representation, their families and any medical treatment they may require;
3. To order their immediate release in the absence of valid legal charges, or, if such charges exist, bring them before an impartial, independent, competent and fair tribunal and guarantee their procedural rights at all times;
4. To order a thorough and impartial investigation into these events in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
5. To guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.

Arbitrary detention/ Fear for safety

The International Secretariat of the World Organisation Against Torture (OMCT) requests your URGENT intervention in the following situation in the People's Republic of China.

Brief description of the situation

The International Secretariat of OMCT has been informed by The Tibetan Centre for Human Rights and Democracy (TCHRD), member of OMCT SOS-Torture network, about the violent arrest of two nuns from Dargay Hardu Nunnery, namely Ven. Jampa Lhamo (30 years old from Sadul Village) and Ven. Rinzin Wangdon (23 years old from Lharinyan Village), located in Kardze County, Kardze "Tibet Autonomous Prefecture", Sichuan Province.

According to the information received, on 23 May 2008, Ven. Jampa Lhamo and Ven. Rinzin Wangdon staged a peaceful protest at the Kardze County Government headquarters and chanted slogans calling for the "swift return of the Dalai Lama to Tibet", "long live the Dalai Lama", "freedom for Tibet" and "immediate release of all political prisoners". The two nuns were then allegedly severely beaten by a group of Public Security Bureau (PSB) officials in situ before being taken to Kardze County PSB Detention Centre reportedly for further questioning. There is currently no information as to their conditions of detention.

The International Secretariat of OMCT is gravely concerned for the safety of Ven. Jampa Lhamo and Ven. Rinzin Wangdon, who, according to the information received, were arrested and detained solely for peacefully exercising their rights to freedom of expression, association and assembly. OMCT fears that they may be subject to torture and ill-treatment. OMCT recalls that China is a State party to the UN Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment which prohibits torture and cruel, inhuman or degrading treatment. OMCT urges the authorities to conform with China's international human rights obligations, commitments that were reaffirmed on the occasion of its election as a member of the new United Nations Human Rights Council.

Please write to the authorities in the People's Republic of China urging them to:

i. Guarantee, in all circumstances, the physical and psychological integrity of Ven. Jampa Lhamo and Ven. Rinzin Wangdon;
ii. Guarantee immediate and unconditional access to legal representation, their families and any medical treatment they may require;
iii. Order their immediate release in the absence of valid legal charges, or, if such charges exist, bring them before an impartial, independent, competent and fair tribunal and guarantee their procedural rights at all times;
