No.4081 キルギス:殺人容疑で恣意的に逮捕された男性が拷問による自白を強要されています。

 SOSトーチャー国際事務局はキルギスにおける以下の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

 SOSトーチャー国際事務局はSOSトーチャー・ネットワークメンバーであるキルギス人権委員会(KCHR)から、ナリンに住むバザバエフ・マクサットさんが留置場で拷問と虐待を受けたという情報を入手しました。彼は現在隔離されて拘禁されているようです。

 情報によると、2008年8月8日バザバエフ・マクサットさんは、7月2日にカラ・バルタで起きたゾルドシュベック・ウウルゥ・エルキンさん殺害の容疑で、令状のないまま、ナリン刑事捜査部の3人の警察官、スルタンという名前らしい内務省の役人(フルネームは不明)、そしてアルスタンという名前らしい警察官(フルネームは不明)によって逮捕されました。

 情報によると、カラ・バルタに向かう途中で警察官たちは車を止め、バザバエフ・マクサットさんに手錠をかけて木に吊るし、下着を脱がして下腹部を殴ったそうです。その後警察官たちはバザバエフ・マクサットさんの頭からセロファン袋をかぶせ、殺人の容疑を認めるよう銃で脅しましたが、彼は否定しました。同日午後11時ごろ、バザバエフ・マクサットさんはトカラ・バルタ内務部に連れて行かれました。そこの1階で、クビチという名前らしい職員(フルネームは不明)がバザバエフ・マクサットさんを壁に押し付け、両耳、両足、腎臓、胃を激しく殴りました。伝えられるところによると、バザバエフ・マクサットさんは、エルキンさん殺害の自白調書を書くよう強要され、8月8日から11日までの間、何度も殴られました。彼はまた頭に袋やガスマスクをかぶせられたということです。

 バザバエフ・マクサットさんは現在、腎臓を悪くし、うっ血や打撲の後遺症を患っていると思われます。1度だけ医師の診察を受けることができ、病院に送るべきだとアドバイスをしたようです。しかし、その代わりに、マクサットさんはモスコヴァスカヤ地区やイシクアチンスク地区にある警察署に転々と送致され、現在は外部との連絡を絶たれたところで拘禁されている模様です。弁護士との面会は1度だけ許されました。

 SOSトーチャー国際事務局は、バザバエフ・マクサットさんの心身の安全を深刻に憂慮しています。さらに国際事務局は、拷問による供述が法廷で証拠として用いられることに懸念を表明します。国際事務局はキルギスが残虐な、非人道的な又は品位を傷つける取扱いを禁止する「拷問等禁止条約」及び「自由権規約(ICCPR)」の締約国であることを指摘します。この条約上の義務に従い、当局はいかなる拷問及び虐待の申立てであれ真剣に検討し徹底的で公平な調査を行う義務があります。拷問等禁止条約第15条は「締約国は、拷問によるものと認められるいかなる供述も、…訴訟手続における証拠としてはならないことを確保する」、第11条は「締約国は、拷問が発生することを無くすため、尋問に係る規則、指示、方法及び慣行並びに自国の管轄の下にある領域内で逮捕され、抑留され又は拘禁される者の身体の拘束及び取扱いに係る措置についての体系的な検討を維持する」と規定しています。

<行動要請>

 キルギス関係当局に以下の内容の要請をお願いします。

1.バザバエフ・マクサットさんの心身の安全を保障するために必要な措置をすべてとること。

2.バザバエフ・マクサットさんが即時無条件で法廷代理人や家族と面会でき、必要な治療を受けられるよう保障すること。

3.国際法および国際基準と合致する正当な嫌疑が不在の中、彼の即時釈放を命じること。もしそのような嫌疑が存在するならば、彼を迅速で公正な裁判に付し、その間の彼の手続き上の権利をすべて保障すること。

4.拷問の申し立てをはじめとしたこれら事件について、責任者を特定し、裁判に付し、法に基づいて刑事あるいは行政罰を適用するために、徹底的で公平な調査を命じること。

5.拷問による自白の証拠は裁判では使わないことを保障すること。

6.バザバエフ・マクサットさんに適切な補償がいくように保障すること。

7.国際人権基準に沿って、国内全土における人権尊重と基本的自由を保障すること。

I am writing you to express my concern over the health conditions and detention of Mr. Bazarbaev Maksat, resident of Naryn. I would like to urge you the followings:

1. To take all necessary measures to guarantee the physical and psychological integrity of Mr. Bazarbaev Maksat;
2. To guarantee Mr. Bazarbaev Maksat immediate and unconditional access to legal representation, his family and any medical care and treatment he may require;
3. To order his immediate release in the absence of valid legal charges that are consistent with international law and standards, and if such charges exist, to ensure that he is given a prompt and fair trial, in which his procedural rights are guaranteed at all times;
4. To order a thorough and impartial investigation into the circumstances of these events, notably the allegations of torture, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
5. To guarantee that no evidence obtained under torture be used in court cases;
6. To guarantee that adequate reparation is awarded to Mr. Bazarbaev Maksat;
7. To guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with international human rights standards.

Torture and ill-treatment/ Incommunicado detention/ Fear for safety/ Fear of unfair trial
The International Secretariat of the World Organization Against Torture (OMCT) requests your URGENT intervention in the following situation in Kyrgyzstan.

Brief description of the situation

The International Secretariat of OMCT has been informed by the Kyrgyz Committee for Human Rights (KCHR), a member of OMCT SOS-Torture network, about the torture and ill-treatment inflicted on Mr. Bazarbaev Maksat, resident of Naryn, while in police custody. He is reportedly currently detained incommunicado.

According to the information received, Mr. Bazarbaev Maksat was arrested without any arrest warrant on 8 August 2008 by three policemen from the Naryn Criminal Investigation Department, an official from the Ministry of Internal Affairs reportedly named Sultan (complete name unknown), and a policeman reportedly named Arstan (complete name unknown), on suspicion of murdering a man named Mr. Zholdoshbek uulu Erkin on 2 July 2008 in Kara-Balta.

According to the same information, on the way to Kara-Balta, the policemen reportedly stopped the car, handcuffed Mr. Bazarbaev Maksat, hang him on a tree, removed his shorts and allegedly started beating him in the genital area. They then reportedly put his head into a cellophane package and threatened him with a gun to admit the allegations of murder, which he repeatedly denied. Later, at about 11:00pm, Mr. Bazarbaev Maksat was taken to Tokara-Balta Department of Internal Affairs. There he was reportedly taken to the ground floor room where an official name Kubich (complete name unknown) beat him severely on his ears, feet, kidneys, and stomach as well as pushed him to the wall. Mr. Bazarbaev Maksat was reportedly beaten repeatedly from 8 to 11 August 2008 in order to have him force to write a confession stating that he had killed Mr. Erkin. He was also allegedly put bags and gas mask on his head.

Mr. Bazarbaev Maksat would now suffer from kidneys problem, hypostasis and multiple contusions. He was reportedly only once able to see a doctor who advised that he should be sent to the hospital. Instead, Mr. Bazarbaev Maksat was sent to different police departments in Sukuluk, Moskovaskaya area, Issyk-Atinsk area, where he is reportedly currently detained incommunicado. He was only able to see his lawyer once.

The International Secretariat of OMCT is gravely concerned for the physical and psychological integrity of Mr. Bazarbaev Maksat. Furthermore, OMCT wishes to express its concern over the use of statements obtained under torture as evidence in a court case. OMCT recalls that Kyrgyzstan is a State party to the UN Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and the International Covenant on Civil and Political Rights (ICCPR), which both prohibit cruel, inhuman or degrading treatment. In line with their obligations under this treaty, it is incumbent on the authorities to consider seriously any allegations of torture and ill-treatment, and to undertake a thorough and impartial investigation in this regard. Article 15 of the Convention against Torture stipulates that,- "each State Party shall ensure that any statement which is established to have been made as a result of torture shall not be invoked as evidence in any proceedings (…)" and Article 11 that "each State Party shall keep under systematic review interrogation rules, instructions, methods and practices as well as arrangements for the custody and treatment of persons subjected to any form of arrest, detention or imprisonment in any territory under its jurisdiction, with a view to preventing any cases of torture".

Action requested

Please write to the authorities in Kyrgyzstan urging them to:

i. Take all necessary measures to guarantee the physical and psychological integrity of Mr. Bazarbaev Maksat;
ii. Guarantee Mr. Bazarbaev Maksat immediate and unconditional access to legal representation, his family and any medical care and treatment he may require;
iii. Order his immediate release in the absence of valid legal charges that are consistent with international law and standards, and if such charges exist, to ensure that he is given a prompt and fair trial, in which his procedural rights are guaranteed at all times;
iv. Order a thorough and impartial investigation into the circumstances of these events, notably the allegations of torture, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
v. Guarantee that no evidence obtained under torture be used in court cases;
vi. Guarantee that adequate reparation is awarded to Mr. Bazarbaev Maksat;
i. Guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with international human rights standards.
