No.4087 ギリシャ:公務員の不正を報道した記者が暴漢に襲撃されました。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、ギリシャにおける以下の状況に関して、皆様の緊急の働きかけをお願いします。

<事件の概要>

 人権擁護家保護のための監視機構は、ギリシャ・ヘルシンキ・モニター(GHM)より報道記者であり人権擁護家でもあるマキス・ノダロスさんが出身地のイリヤ県(西ギリシャ)のレチェナで襲撃されたという情報を入手しました。

 入手した情報によると、2008年10月23日午前11時ごろ、アテネ・デイリー・エレフセロティピア、パトラ・デイリー・イメラ、パトラのテレビ局テレタイム及びパトラのラジオ局ガマの特派員でありイリヤのラジオ局イオニアFMの番組司会者でもあるマキス・ノダロスさんはラジオ番組終了後の帰宅途中、2人の正体不明の男たちによって襲撃されました。

 2人はマキス・ノダロスさんに近づき、本人かどうかを尋ね、その後彼が倒れて出血した後も何回も殴ったり蹴ったりしました。2人の襲撃者は彼のノートパソコンを壊し、携帯電話を盗み、その後現場近くに隠してあったバイクに乗って逃げました。マキス・ノダロスさんは地域の診療所で応急手当を受け、頭部、手及び足に傷があると診断され、その後帰宅しました。

 監視機構はマキス・ノダロスさんの襲撃を、それが彼の人権活動への制裁と思われるため、深く憂慮します。実際、マキス・ノダロスさんは、政府や地方当局や非政府機関が昨年起きた森林火災の被害者に対する支援金を不正管理したことや役人の汚職を暴く記事を多く書いています。彼は10月23日以前にも脅迫を受けていました。マキス・ノダロスさんは最近イリヤ県のザチャロ近くにある町の町長が関与した汚職について記事を書きました。この町長はマキス・ノダロスさんをイリヤ県の地方新聞社から解雇させ、ノダロスさんとその記事を出した新聞社を相手取って訴えたようです。一方、町長は司法調査と行政調査の対象になっています。

 2006年、マキス・ノダロスさんは2004年に日刊紙プロティで未成年者の性的搾取について記事を書いたため、名誉毀損で訴えられていました。

<行動要請>

1.いかなる情況にあろうとも、マキス・ノダロスさんの心身の安全を保障すること。

2.責任者を特定し、資格ある公正な裁判に付し、法に基づいて刑事罰を適用できるよう、これら事件について徹底的で公正な調査を行うよう命じること。

3.ギリシャのすべての人権擁護家に対する司法レベルも含んだあらゆる嫌がらせ行為を停止すること。

4.1998年12月9日に国連総会が採択した人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を守ること。

5.さらには、世界人権宣言およびギリシャが批准した国際・地域人権文書に沿って、国内全土における人権尊重と基本的自由を保障すること。

I am writing you to express my concern over the recent assaults on Mr. Makis Nodaros, a journalist and human rights defender in the town of Lechaina. I would like to urge you the followings:

1. To guarantee in all circumstances the physical and psychological integrity of Mr. Makis Nodaros;
2. To order a thorough and impartial investigation into the above-mentioned assault, in order to identify all those responsible, bring them before an ordinary competent and impartial tribunal and apply to them the penal sanctions provided by the law;
3. To put an end to all acts of harassment, including at the judicial level, against all human rights defenders in Greece;
4. To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its Article 1, which states that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels", and Article 12.2, which provides that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
5. More generally, to ensure in all circumstances the respect for human rights and fundamental freedoms in accordance with the Universal Declaration of Human Rights and with international and regional human rights instruments ratified by Greece.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your intervention in the following situation in Greece.

Description of the situation:

The Observatory has been informed by the Greek Helsinki Monitor (GHM) about the assault on Mr. Makis Nodaros, a journalist and human rights defender, in his home town of Lechaina in Elia (Western Greece).

According to the information received, on October 23, 2008, Mr. Makis Nodaros, the Elia regional correspondent for the Athens daily Eleftherotypia, the Patras daily Imera, the Patras television station Teletime, the Patras radio station Radio Gamma, and also the host of a daily programme for the Elia radio station Ionian FM, was attacked by two unidentified men at around 11 a.m. as he was returning home after his daily radio programme.

The two men approached him, asked him if he was Makis Nodaros, and then punched and kicked him many times, even after he had fallen down and bled. The two assailants tried to break his laptop, stole his mobile phone, and then fled on a motorcycle they had hidden close to the place of the incident. He was offered first aid treatment at the regional medical centre and was diagnosed with head, hand and foot wounds, and later returned home.

The Observatory is deeply concerned by this assault against Mr. Makis Nodaros as it seems to sanction his human rights activities. Indeed, Mr. Nodaros recently wrote a number of articles exposing corruption and mismanagement over relief provided by the Government, local authorities and non-government institutions for victims of forest fires, which last year destroyed a large part of the region. He had received threats before the attack of October 23. Mr. Nodaros has also recently published several articles about alleged corruption involving the Mayor of the adjacent Elia town of Zacharo. The Mayor reportedly succeeded in having him fired from a local Elia newspaper, and has also announced that he is filing lawsuits against Mr. Nodaros and the newspapers in which he published his articles. The Mayor is also the target of judicial and administrative investigations.

In 2006, Mr. Makis Nodaros had already been prosecuted for aggravated defamation, subsequent to an article published in 2004 article in the local Pyrgos-based daily Proti, in which he was expressing his concern for the sexual exploitation of a minor.

Action requested:

Please write to the authorities in Greece urging them to:

i. Guarantee in all circumstances the physical and psychological integrity of Mr. Makis Nodaros;
ii. Order a thorough and impartial investigation into the above-mentioned assault, in order to identify all those responsible, bring them before an ordinary competent and impartial tribunal and apply to them the penal sanctions provided by the law;
iii. Put an end to all acts of harassment, including at the judicial level, against all human rights defenders in Greece;
iv.
