No.4092 中国:政治活動家でもある大学の准教授が恣意的に拘禁されました。

 SOSトーチャー国際事務局は中国における以下の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

 SOSトーチャー国際事務局は信頼できる情報筋及びSOSトーチャー・ネットワークメンバーであるアンテナ・インターナショナルより、2008年11月13日に政治活動家であり南京師範大学の准教授であるグオ・クァン(郭泉)さんが拘禁されたという情報を入手しました。

 情報によると、2008年11月13日に郭泉さんは南京市公安部(PSB)の警察官により拘禁されました。警察は郭さんの自宅を捜索して、論文を多数押収しました。その後警察は郭さんの妻に夫は「国家転覆煽動」のため刑事拘禁されたと言ったそうです。

 同じ情報によると、現在のところ郭さんの拘禁の理由は明確ではありません。しかし郭さんは2007年12月に設立された中国新民党を組織し、インターネット上で南京市当局、特に市内へのパラキシレン生産工場建設を批判する論文を発表してきました。彼は2008年5月17日から28日にかけ、中国新民党の他のメンバーと共に2008年5月12日の四川大地震に対する同党の対策を論じたことで、行政罰の一つである「公序を乱したことによる拘禁」を南京市警察から受けたことがありました。その行動により郭さんは学校で教えることを禁止されているようです。

 SOSトーチャー国際事務局は、単に表現、結社及び集会の自由についての権利を行使したことで郭泉さんが拘禁されていることに懸念を表明します。国際事務局はさらに彼の心身の安全を危惧します。国際事務局は中国が拷問及び他の残虐な、非人道的な又は品位を傷つける取り扱いを禁止する拷問等禁止条約の締約国であることを指摘します。国際事務局は中国当局が国際人権法上の義務及び国連人権理事会の理事国選挙の際に行った公約に従うことを要請します。

<行動要請>

 中国関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうとも、郭泉さんの心身の安全を保障すること。

2.法廷代理人および家族との面会と必要な医療措置を即時無条件で保障すること。

3.正当な嫌疑が不在の中、彼の即時釈放を命じること。もしそのような嫌疑が存在するならば、彼を公正で独立した資格ある裁判に付し、その間の彼の手続き上の権利をすべて保障すること。

4.責任者すべてを特定し、裁判に付し、法に基づき刑事あるいは行政罰を適用できるよう、これら事件の徹底的かつ公正な調査を命じること。

5.国内法および国際人権基準に沿って、国内全土における人権尊重と基本的自由を保障すること。

I am writing you to express my concern over the detention of Mr. Guo Quan, a political activist and an Associate Professor at Nanjing Normal University, on 13 November 2008. I would like to urge you the followings:

1.To guarantee, in all circumstances, the physical and psychological integrity of Mr. Guo Quan;
2. To guarantee immediate and unconditional access to legal representation, his family and any medical treatment he may require;
3. To order his immediate release in the absence of valid legal charges, or, if such charges exist, bring him before an impartial, independent, competent and fair tribunal and guarantee his procedural rights at all times;
4. To order a thorough and impartial investigation into these events in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
5. To guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.

Arbitrary detention/ Fear for safety

The International Secretariat of the World Organisation Against Torture (OMCT) requests your URGENT intervention in the following situation in the People’s Republic of China.

Brief description of the situation

The International Secretariat of OMCT has been informed by a reliable source and Antenna International, a member organisation of OMCT SOS-Torture Network, about the detention of Mr. Guo Quan, a political activist and an Associate Professor at Nanjing Normal University, on 13 November 2008.

According to the information received, on 13 November 2008, Mr. Guo Quan was reportedly taken into custody by police from Nanjing City Public Security Bureau (PSB). The police reportedly searched Mr. Guo’s home and confiscated a number of articles. The police then told Mr. Guo’s wife that her husband had been criminally detained for “inciting subversion of state power”.

According to the same information, the reasons of Mr. Guo’s detention are currently unclear. But Mr. Guo recently organised China Xinmin Party, a new party he established in December 2007, and he has published online articles that criticize the Nanjing government, particularly for its construction of paraxylene plant in the city. He has already been subjected to “detention for violation of public order”, a form of administrative punishment, by the Nanjing police, between 17 and 28 May 2008, for reportedly having discussed with other members of China Xinmin Party its response to the 12 May 2008 Sichuan earthquake. Due to his activism, Mr. Guo has reportedly been barred from teaching.

The International Secretariat of OMCT expresses its concern with regard to the detention of Mr. Guo Quan, which, according to the information received, seemed to be based solely for exercising his rights to freedom of expression, association and assembly. OMCT further fears for his safety. OMCT recalls that China is a State party to the UN Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment which prohibits torture and cruel, inhuman or degrading treatment. OMCT urges the authorities to conform with China’s international human rights obligations, commitments that were reaffirmed on the occasion of its election as a member of the new United Nations Human Rights Council.

Please write to the authorities in the People’s Republic of China urging them to:
i. Guarantee, in all circumstances, the physical and psychological integrity of Mr. Guo Quan;
ii. Guarantee immediate and unconditional access to legal representation, his family and any medical treatment he may require;
iii. Order his immediate release in the absence of valid legal charges, or, if such charges exist, bring him before an impartial, independent, competent and fair tribunal and guarantee his procedural rights at all times;
iv. Order a thorough and impartial investigation into these events in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
