No.4096 インド:ジャーナリストが路上で目隠しされ後手に縛られた形で殺害されました。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」はインドにおける以下の状況に関して、皆様の緊急の働きかけをお願いします。

<事件の概要>

 人権擁護家保護のための監視機構は組織研究教育センター(CORE)より、インド・マニプル州の英字日刊紙インパール自由新聞の編集者、コンソム・リシカンタさんの殺害について情報を入手しました。

 情報によると、2008年11月17日午後4時半ごろマニプル州西部インパールのランフェル警察署に近いランゴルで、25歳のコンソム・リシカンタさんが胸と首筋に2発の銃弾を受けて死亡しました。リシカンタさんは目隠しされ、後ろ手に縛られ、布でさるぐつわされた状態で発見されました。

 この緊急アピールの時点で誰がなぜ射殺したのかなどは不明なままです。しかし監視機構はリシカンタさんが政府及びマニプル州の反政府武装集団双方によって行われた人権侵害を非難していたことより、超法規的的に殺害されたのではないかと危惧しています。

 さらに亡くなったリシカンタさんが発見された場所がある地域は、その付近一帯に入るには国軍の厳重な監視を通過しなくてはならないため、彼の殺害には国軍の兵士が関与しているのではないかと危惧されます。
監視機構はコンソム・リシカンタさんの超法規的殺害に深い懸念を表明し、すべての責任者を特定し、公平かつ資格のある裁判に付し、法に沿って刑事罰を適用するために、インド当局が彼の殺害について迅速、徹底的かつ公平な調査を命令するよう要請します。

 監視機構はまた、2007年にインドが3年の任期で人権理事会の理事国として選出され、「人権の保護及び促進において最高水準を維持する」ことを約束したことを指摘します。

<行動要請>

 インド関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうとも、インドのすべての人権擁護家の心身の安全を保障するよう必要な措置をとること。

2.コンソム・リシカンタさんの殺害に責任のあるものすべてを特定し、資格のある公平な裁判に付し、法に基づいて刑事罰を適用できるよう、この事件について公平で徹底した調査を迅速に行うよう命じること。

3.彼の家族に適切な補償を行うこと。

4.インドのすべての人権擁護家に対するあらゆる形態の嫌がらせ行為に終止符を打つこと。

5.1998年12月9日に国連総会が採択した人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を守ること。

6.世界人権宣言およびインドが批准した国際文書に従い、国内全土における人権尊重と基本的自由を保障すること。

1. To take all necessary measures to guarantee, in all circumstances, the physical and psychological integrity of all human rights defenders in India;
2. To order an immediate, thorough and impartial investigation into Mr. Konsom Rishikanta's assassination, in order to identify all those responsible, bring them before a competent and impartial tribunal and apply to them the penal sanctions provided by the law;
3. To guarantee that adequate reparation is provided to his relatives;
4. To put an end to any act of harassment against all human rights defenders in India;
5. To comply with the provisions of the Declaration on Human Rights Defenders adopted by the UN General Assembly on December 9, 1998, in particular Article 1, which states that "everyone has the right, individually or collectively, to promote the protection and fulfilment of human rights and fundamental freedoms at the national and international levels", as well as Article 12.2, which provides that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
6. To guarantee the respect of human rights and fundamental freedoms in accordance with the Universal Declaration on Human Rights and other international human rights instruments ratified by India.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in India.

Brief description of the situation:

The Observatory has been informed by the Centre for Organisation, Research and Education (CORE) about the assassination of Mr. Konsom Rishikanta, Junior Sub-Editor of the English daily Imphal Free Press, in Manipur, India.
According to the information received, on November 17, 2008, at about 4:30 pm at Langol, near the Lamphel Police Station, Imphal West district of Manipur, Mr. Konsom Rishikanta, 25 years old, was shot dead with two bullets on the chest and one on the neck. Mr. Rishikanta was found blind folded, his hands tied behind, and his mouth gagged with a piece of cloth.

As of issuing this urgent appeal, the motives and identities of the gunmen remained unknown. However, the Observatory fears that Mr. Rishikanta's extrajudicial killing might be linked to his human rights activities, as Mr. Rishikanta used to denounce human rights violations committed by both the government and armed opposition groups in Manipur.

Furthermore, it is feared that members of State forces may be involved in Mr. Rishikanta's extra-judicial killing as the spot where Mr. Rishikanta was found dead is a highly secured area with members of State forces controlling all the three entry points.

The Observatory expresses its deep concern about Mr. Konsom Rishikanta's extrajudicial killing, and urges the Indian authorities to order an immediate, thorough and impartial investigation into his assassination, in order to identify all those responsible, bring them before a competent and impartial tribunal and apply to them the penal sanctions provided by the law.

The Observatory also recalls that India was elected as a member of the Human Rights Council in 2007 for three years, and has committed, in this regard, to "uphold the highest standards of promotion and protection of human rights".

Action requested:
Please write to the Indian authorities and ask them to:

i. Take all necessary measures to guarantee, in all circumstances, the physical and psychological integrity of all human rights defenders in India;
ii. Order an immediate, thorough and impartial investigation into Mr. Konsom Rishikanta's assassination, in order to identify all those responsible, bring them before a competent and impartial tribunal and apply to them the penal sanctions provided by the law;
iii. Guarantee that adequate reparation is provided to his relatives;

iv. Put an end to any act of harassment against all human rights defenders in India;
v. Comply with the provisions of the Declaration on Human Rights Defenders adopted by the UN General Assembly on December 9, 1998, in particular Article 1, which states that "everyone has the right, individually or collectively, to promote the protection and fulfilment of human rights and fundamental freedoms at the national and international levels", as well as Article 12.2, which provides that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
