No.4097 ネパール:窃盗容疑で逮捕された男性が拷問による自白を強要されました。

SOSトーチャー国際事務局はネパールにおける以下の状況に関して、皆様の緊急の働きかけをお願いします。

<事件の概要>

 SOSトーチャー国際事務局は信頼できる情報筋およびSOSトーチャー・ネットワークメンバーであるアンテナ・インターナショナルより、ラメチャップ郡ビジュリコットVDC区5番に住む39歳の工場主ティカ・プラサド・ダハルさんが警察での拘禁中に受けた拷問及び虐待について情報を入手しました。

 情報によると、2008年11月16日の正午にティカ・プラサド・ダハルさんはバイクの窃盗・転売に関与したとして、都市交通警察部の警官隊(名前や階級は特定されていません)によって逮捕され、都市交通警察部に連行され、そこでひどく殴られたそうです。

 情報によると、3人の私服警察官がバイクの窃盗・転売についてティカ・プラサド・ダハルさんを尋問し、手足と背中を竹の棒や鉄の鎖で叩きました。3人の警察官は彼を叩きながら、盗んだバイクの台数や窃盗に関与した仲間の名前を尋ねたそうです。ティカ・プラサド・ダハルさんは約30分にわたり耳や頭を殴られた後、2人の警察官によって別室に連れていかれました。そこでも尋問中に体のあちこちを殴られたり竹の棒で叩かれたりしました。結局、こうした行為を終らせるためティカ・プラサド・ダハルさんは自白した模様です。

 その後、ティカ・プラサド・ダハルさんは仲間と思しき人たちがいる場所に案内させられ、午後6時半頃カトマンズのハヌマンドカ警察に連行され、そこで2人の私服警官にプラスティック製のパイプで後頭部などを殴られました。そして窃盗・転売したバイクの台数について再び取調べを受けたそうです。

 2008年11月19日、ティカ・プラサド・ダハルさんはカトマンズ地方裁判所に出廷し、窃盗の罪状で起訴されました。2008年11月23日、取り調べ中に受けた拷問と虐待により精神障害をきたしたティカ・プラサド・ダハルさんはラリトプルの精神病院に入院し、そこでハヌマンドカ都市警察の監視下に置かれています。

 SOSトーチャー国際事務局は、警察で自白強要のためにティカ・プラサド・ダハルさんが受けた拷問と虐待について深い懸念を表明します。国際事務局は警察の監視下のもとさらなる拷問と虐待の危険にさらされている彼の心身の安全を危惧します。国際事務局はネパールが残虐な、非人道的な又は品位を傷つける取扱いを禁止する拷問等禁止条約及び自由権規約の締約国であることを指摘します。国際事務局はさらに「締約国は、拷問が発生することを無くすため、尋問に係る規則、指示、方法及び慣行並びに自国の管轄の下にある領域内で逮捕され、抑留され又は拘禁される者の身体の拘束及び取扱いに係る措置についての体系的な検討を維持する」とする拷問等禁止条約第11条及び「締約国は、拷問によるものと認められるいかなる供述も…訴訟手続における証拠としてはならないことを確保する」とする同条約第15条を指摘します。これらの条約上の義務に沿って、ネパール当局には拷問及び虐待についてのいかなる申立ても真剣に検討し徹底的な調査を行う義務があります。

<行動要請>

 ネパール関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうともティカ・プラサド・ダハルさんの心身の安全を保障すること。

2.弁護士および家族との面会と必要とする医療へのアクセスを無条件で保障すること。

3.拷問等禁止条約第15条で規定されているように、拷問による自白を裁判の証拠として使わないよう保障すること。

4.国際法および国際基準に準拠する正当な嫌疑が不在の中、彼の即時無条件釈放を命じること。もしそのような嫌疑が存在するならば、彼を公平で資格のある裁判に付し、その間の手続き上の権利をすべて保障すること。

5.これら一連の拷問および虐待の申し立てについて、すべての責任者を特定し、裁判に付し、法に基づき刑事あるいは行政罰を適用できるよう、徹底的で公平な調査を命じること。

6.ティカ・プラサド・ダハルさんへの補償を保障すること。

7.国内法および国際人権基準に沿って、国内全土における人権尊重と基本的自由を保障すること。とりわけ、拷問等禁止条約第1条の規定にしたがい、国内法にてあらゆる形態の拷問行為を明確に犯罪として規定し、拷問等禁止条約第4条で求められているようにその深刻な犯罪性を考慮に入れて、適切な刑罰が適用されるようにすること。

I am writing you to express my concern over the torture and ill-treatment in the police custody inflicted upon Mr. Tika Prasad Dahal, a permanent resident of Ramechhap, district Bijulikot VDC ward no. 5. I would like to urge you the followings:

1. To guarantee, in all circumstances, the physical and psychological integrity of Mr. Tika Prasad Dahal;
2. To guarantee unconditional access to his lawyer, family and any medical treatment and care he may require;
3. To guarantee that no evidence obtained under torture be used in the court case as stipulated in Article 15 of the UN Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment;
4. To order his immediate release in the absence of valid legal charges that are consistent with international law and standards, or if such charges exist, bring him before an impartial and competent tribunal and guarantee his procedural rights at all times;
5. To order a thorough and impartial investigation into these events, notably the allegations of torture and ill-treatment, in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
6. To guarantee that adequate compensation is awarded to Mr. Tika Prasad Dahal;
7. To ensure the respect of human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards, in particular ensure that all acts of torture are clearly defined in law as offences in accordance with the provisions set out in Article 1 of the Convention against Torture and shall be made punishable with appropriate penalties which take into account the grave nature of the crimes as required under Article 4 of the Convention against Torture.

Torture and ill-treatment/ Fear for safety/ Risk of impunity

The International Secretariat of the World Organisation Against Torture (OMCT) requests your URGENT intervention in the following situation in Nepal.

Brief description of the situation

The International Secretariat of OMCT has been informed by a reliable source and Antenna International, a member of OMCT SOS-Torture Network, about the torture and ill-treatment in police custody inflicted upon 39-year-old factory owner, Mr. Tika Prasad Dahal, permanent resident of Ramechhap, district Bijulikot VDC ward no. 5 and temporarily residing in Sanepa.

According to the information received, on 16 November 2008 at noon, Mr. Tika Prasad Dahal was arrested by a group of policemen of Metropolitan Traffic Police Division (names and ranks not identified) allegedly for being involved in a racket of motorbike theft and sell and taken to Metropolitan Traffic Police Division where he was allegedly severely beaten.

According to the same information, three policemen in plain clothes beat Mr. Tika Prasad Dahal with a bamboo stick and an iron chain on his hands, legs and back, while accusing him of stealing and selling several motorbikes. The three policemen repeatedly beat him and ask him the number of motorbikes he had stolen and the names of others involved in the business. Mr. Tika Prasad Dahal was allegedly slapped and punched on his ears and head for about half an hour, following which he was taken to another room by two other policemen. There, he was reportedly beaten on different parts of his body with punches and bamboo sticks while being asked questions with regards the case. After a while, Mr. Tika Prasad Dahal allegedly confessed in order to stop the beatings.

Mr. Tika Prasad Dahal was then reportedly taken to several different places to assist to the arrest of his friends and at about 6:30pm, he was brought to Metropolitan Police Range Hanumandhoka, Kathmandu, where he was allegedly again beaten by two policemen in plain clothes with a plastic black pipe on his legs and calves. He was punched on the backside of his head and made to lie on the floor while being beaten. He was reportedly once more interrogated on the number of motorbikes stolen and sold.

On 19 November 2008, Mr. Tika Prasad Dahal was presented before the Kathmandu District Court and charged of theft. On 23 November 2008, he was hospitalised for mental disorder, reportedly due to the torture and ill-treatment suffered, and has remained under Metropolitan Police Range Hanumandhoka control at Mental Hospital of Lalitpur.

The International Secretariat of OMCT expresses its deep concern about the torture and ill-treatment inflicted upon Mr. Tika Prasad Dahal while in police custody in order to obtain a confession. OMCT fears for his safety as he remains under police control being at particular risk of further torture and ill-treatment. OMCT recalls that Nepal is a State party to the UN Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment and the International Covenant on Civil and Political Rights (ICCPR), which both prohibit cruel, inhuman or degrading treatment. OMCT further recalls Article 11 of the Convention against Torture "Each State Party shall keep under systematic review interrogation rules, instructions, methods and practices as well as arrangements for the custody and treatment of persons subjected to any form of arrest, detention or imprisonment in any territory under its jurisdiction, with a view to preventing any cases of torture"and article 15 of the said Convention, "Each State Party shall ensure that any statement which is established to have been made as a result of torture shall not be invoked as evidence in any proceedings (…)".In line with their obligations under these treaties, it is incumbent on the Nepalese authorities to consider seriously any allegations of torture and ill-treatment, and to undertake a thorough investigation in this regard.
Action requested

Please write to the authorities in Nepal urging them to:

i. Guarantee, in all circumstances, the physical and psychological integrity of Mr. Tika Prasad Dahal;
ii. Guarantee unconditional access to his lawyer, family and any medical treatment and care he may require;
iii. Guarantee that no evidence obtained under torture be used in the court case as stipulated in Article 15 of the UN Convention Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment;
iv. Order his immediate release in the absence of valid legal charges that are consistent with international law and standards, or if such charges exist, bring him before an impartial and competent tribunal and guarantee his procedural rights at all times;
v. Order a thorough and impartial investigation into these events, notably the allegations of torture and ill-treatment, in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
vi. Guarantee that adequate compensation is awarded to Mr. Tika Prasad Dahal;
vii. Ensure the respect of human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards, in particular ensure that all acts of torture are clearly defined in law as offences in accordance with the provisions set out in Article 1 of the Convention against Torture and shall be made punishable with appropriate penalties which take into account the grave nature of the crimes as required under Article 4 of the Convention against Torture.
