No. 4101 カンボジア:労組委員長殺害の冤罪を受けた2人の男性が保釈されましたが、司法手続きはそのまま続いています。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」はカンボジアにおける以下の状況に関して、引き続き皆様の働きかけをお願いします

<事件の概要>

 人権擁護家保護のための監視機構は、国際労働組合総連合(ITUC)を含む信頼できる情報筋より、2005年以来プレイ・サー刑務所に恣意的に拘禁されてきたボム・サムナンさんとソク・サム・オエムさんが保釈されたという情報を受け取りました。二人は2004年1月22日に起きたカンボジア王国労働者組合(FTUWKC)の委員長チェ・ヴィチェさん射殺事件の責任者として濡れ衣を着せられています。

 情報によれば、2008年12月31日、カンボジア最高裁判所は二人の保釈を命じ、事件を再審のために控訴裁判所に付託しました。

 二人はチェ・ウィチェさん殺害事件で証人の脅迫という政治的妨害が入った裁判により殺人犯に仕立て上げられ、5年近く拘禁されていました。裁判手続きは国際法の基準をいくつか違反していると考えられます。特に、チェ・ウィチェさん殺害事件の調査は自白の強要と証人への脅迫など警察の暴挙により妨害されたと申し立てられています。

 国際事務局はボム・サムナンさんとソク・サム・オエムさんの保釈を歓迎し、二人のために介入をしてくださったすべての個人および機関、組織にお礼を申し上げます。しかし、国際事務局は彼らに対する執拗な司法の嫌がらせに深い懸念を表明します。国際事務局はまた、チェ・ウィチェさん暗殺について真の責任者の追及が放置されていることを非難し、カンボジア当局に殺害事件の完全で公正な調査を開始して、責任者を裁判に付すよう要請します。

<背景情報>

 2005年8月1日、プノンペン市裁判所はボム・サムナンさんとソク・サム・オエムさんに20年の実刑と3,800ユーロの損害賠償の判決を出しました。

 2006年8月10日、チェア・ヴィチェアさん殺害現場の前の新聞スタンド所有者であるヴァル・ソシィさんは、2人の男性の無実を証明する正確な証言を行いました。証言は殺害の様子、犯人と共犯者、それに彼らが使った車について詳しく説明したものでした。

 2006年8月、2人の男性逮捕に責任のある刑事(元プロンペン警察署長)は、フランスの雑誌L'Expressのインタビューで取り調べの最初から2人の男性は無実であると考えていたことを明かしました。そのインタビュー後、彼はカンボジアから離れています。

 2007年4月12日、控訴審はボム・サムナンさんとソク・サム・オエムさんに対する一審の判決を支持しました。その裁定は2人の男性の無実を示す証拠が厳然と存在するにもかかわらず、多数の不規則な行為による裁判妨害のあと出されました。事実、控訴審の判事は、警察の最初の調査に食い違いがあることを認め、事実を明らかにするために追加の調査を命じるよう裁判所に勧告した検察の結論を却下しました。控訴裁判所はまた、ボム・サムナンさんは事件当日ニアクロンの町にいたとする証言は信ぴょう性に欠けるとして、証言の有効性を認めませんでした。裁判所はまた、ボムン・サムナンさんが最初の自白の撤回も認めませんでした。また、判事はヴァル・ソシさんがタイで宣誓供述をし公証人が証明した新証言を取り上げることも拒否しました。

<行動要請>

 カンボジア関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうとも、カンボジアのすべての人権擁護家の心身の安全を保障すること。

2.ボム・サムナンさんとソク・サム・オエムさんに対する司法手続きを中止すること。

3.犯人を特定し、裁判に付し、犯罪の重さに応じた判決を出すために、チェ・ヴィチェさん暗殺事件に公平、公正で独立した調査を実施すること。

4.チェ・ヴィチェさんの家族に適切な補償を保障すること。

5.カンボジアの人権擁護家に対するあらゆる形態の嫌がらせを止めること。

6.1998年12月9日に国連総会が採択した国連人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項に従うこと。

7.世界人権宣言およびカンボジアが批准した国際文書に従い、国内全土における人権尊重と基本的自由を保障すること。

I am writing you to express my concern about the safety of Messrs. Born Samnang and Sok Sam Oeun, who were arbitrarily detained in the Prey Sar prison since 2005 after being falsely accused of murdering Mr. Chea Vichea, President of the Trade Union of Workers of the Kingdom of Cambodia (FTUWKC), who was shot dead on January 22, 2004. 4. To guarantee that adequate reparation is provided to Mr. Chea Vichea's family;
5. To put an end to all forms of harassment against human rights defenders in Cambodia;
6. To conform with the provisions of the Declaration on Human Rights Defenders adopted by the UN General Assembly on December 9, 1998, in particular its article 1 which provides that "every person has the right, individually or collectively, to promote the protection and fulfilment of human rights and fundamental liberties at the national and international levels", as well as its article 12.2, which provides that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
7. To guarantee the respect of human rights and fundamental freedoms in accordance with the Universal Declaration on Human Rights and other international human rights instruments ratified by Cambodia.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), has received new information and expresses its deepest concern regarding the following situation in Cambodia.

New information:

The Observatory has been informed by reliable sources, including the International Trade Union Confederation (ITUC), about the release on bail of Messrs. Born Samnang and Sok Sam Oeun, who were arbitrarily detained in the Prey Sar prison since 2005 after being falsely accused of murdering Mr. Chea Vichea, President of the Trade Union of Workers of the Kingdom of Cambodia (FTUWKC), who was shot dead on January 22, 2004.

According to the information received, on December 31, 2008, the Cambodian Supreme Court ordered the release on bail Messrs. Born Samnang and Sok Sam Oeun and sent the case back to the Court of Appeals to be retried.

The two men have spent close to five years in prison on false charges of killing Mr. Chea Vichea in a judicial process marred by political interference, intimidation of witnesses, and other violations of international legal standards. In particular, the investigation into Mr. Vichea's murder was marred by alleged police brutality, a forced confession by one of the suspects and intimidation of witnesses (See background information).

The Observatory welcomes Messrs. Born Samnang and Sok Sam Oeun's release on bail, and thanks all the persons, institutions and organisations who intervened in their favour. However, the Observatory expresses its deep concern about the persistence of the judicial harassment against them. The Observatory also denounces the ongoing impunity for Mr. Chea Vichea's assassination, and calls upon the Cambodian authorities to launch a full and impartial investigation into his murder and finally bring those responsible to justice.

Background information:

On August 1, 2005, the Phnom Penh Municipal Court had sentenced Messrs. Born Samnang and Sok Sam Oeung to 20 years' imprisonment and 3,800 Euros in damages.

On August 10, 2006, Ms. Var Sothy, the owner of the newspaper stand in front of which Mr. Chea Vichea was killed, had produced a precise account showing the innocence of the two men, describing in detail the assassination, the murderer and his accomplice, their vehicle, etc.

In August 2006, the police officer responsible for the arrest of the two men, Mr. Hent Pov, former Superintendent of Phnom Penh, had admitted, in an interview given to the French magazine L'Express, that from the outset of the enquiry he had believed the two men to be innocent. He has since fled Cambodia.

On April 12, 2007, the Court of Appeal had upheld the sentencing of Messrs. Born Samnang and Sok Sam Oeun. The ruling was handed down following a trial marred with numerous irregularities, and despite overwhelming evidence of the innocence of the two men. Indeed, the judges of the Court of Appeal rejected the conclusions and recommendations of the Prosecutor, who had admitted that there were gaps in the first police investigation, and who had recommended that the Court order an additional investigation to find out the truth. The Court also refused to accept the validity of testimonies in favour of Mr. Born Samnang, expressing doubts about the reliability of witnesses who had asserted that the accused was in Neak Loeung on the day of the murder, whereas the Municipal Court had accepted the written statements of witnesses for the prosecution, who never appeared in court. Nor did the Court accept Mr. Born Samnang's recanting of his initial confession. Lastly, the judges refused to take into account the new evidence produced by Ms. Var Sothy, in a statement made under oath and certified by a notary in Thailand.

Action requested:

Please write to the Cambodian authorities and ask them to:

i. Guarantee in all circumstances the physical and psychological integrity of all human rights defenders in Cambodia;
ii. Put an end to the judicial proceedings against Messrs. Born Samnang and Sok Sam Oeun;
iii.Conduct a fair, impartial and independent inquiry into the assassination of Mr. Chea Vichea, in order to identify the authors, bring them to justice and pronounce sentences proportional to the gravity of their crimes;
iv. Guarantee that adequate reparation is provided to Mr. Chea Vichea's family;
v. Put an end to all forms of harassment against human rights defenders in Cambodia;
vi.
