No.4104 スリランカ:内戦の平和的政治解決を提唱していた新聞編集長兼人権弁護士が暗殺されました。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」はスリランカにおける以下の状況に関して、引き続き皆様の働きかけをお願いします。

<事件の概要>

 人権擁護家保護のための監視機構は信頼できる情報源より「サンデーリーダー」紙の創設者・編集長であり弁護士でもあるカサンサ・ウィッカーマトゥンゲさんが暗殺されたという情報を受けました。ウィッカーマドゥンゲさんはスリランカ当局の汚職や職権乱用と内戦に関する政府の方針について歯に衣着せぬ批判を行ってきました。

 情報によれば、2009年1月8日午前10時45分頃、 カサンサ・ウィッカーマトゥンゲさんが車で職場に向かっている途中、コロンボのラトマラナ地区のアティディヤ道路で、バイクに乗った4人の正体不明の男性に銃撃されました。銃撃現場はラトマラナ軍基地の近くです。頭に銃弾を受けたカサンサ・ウィッカーマトゥンゲさんは重体の状態でカルボウィラ教員病院に連れていかれ、その日の午後2時10分くらいに亡くなりました。

 これまでカサンサ・ウィッカーマトゥンゲさんは、スリランカ政府や社会全体にはびこる腐敗や縁故主義について、またそれらに伴う不処罰について調査・報道したことで、殺しの脅しを受けたり裁判に訴えられたりしていました。カサンサ・ウィッカーマトゥンゲさんはまた、内戦に対して批判的であり、話し合いによる政治的解決を唱えてきました。

 監視機構国際事務局はカサンサ・ウィッカーマトゥンゲさんの暗殺は、「サンデー・リーダー」紙の編集長としての彼の活動や、スリランカの内戦に関する政府政策の歯に衣着せぬ批判と直接関係していると考えます。

 監視機構国際事務局はスリランカの人権擁護家が直面している非常に危険な情況を改めて示しているカサンサ・ウィッカーマトゥンゲさんの暗殺に深い懸念を表明し、殺害の責任者すべてを特定し、資格ある公平な裁判に付し、法に基づき刑事処罰を適用できるよう、彼の殺害事件について迅速で徹底的で公平な調査を命じるよう、スリランカ当局に要請します。

<行動要請>

 スリランカ関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうともスリランカのすべての人権擁護家の心身の安全を保障すること。

2.カサンサ・ウィッカーマトゥンゲさんの殺害について、すべての責任者を特定し、文民の資格ある公平な裁判に付し、法に基づき刑事処罰を適用できるよう、徹底的で公平な調査を命じること。

3.スリランカのすべての人権擁護家並びに人道活動家に対するあらゆる形態の嫌がらせに終止符を打つこと。

4.1998年12月9日国連総会が採択した人権擁護家に関する宣言の条文、とりわけ、 「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項を守ること。

5.いかなる情況にあろうとも、国際人権基準並びにスリランカが批准した国際文書に従い、国内全土における人権尊重と基本的自由を保障すること。

Dear President Rajapakse,

I am writing you to express my concern over the killing of Mr. Lasantha Wickrematunge on January 8. Mr. Lasantha Wickrematunge, a human rights lawyer and the chief editor of "Sunday Leader" newspaper, was shot dead by four gunmen on the road while he was driving. I would like to urge you the followings:

1. To guarantee in all circumstances the physical and psychological integrity of all Sri Lankan human rights defenders;
2. To order a thorough and impartial investigation into the killing of Mr. Lasantha Wickrematunge, in order to identify all those responsible, bring them before a civil competent and impartial tribunal and apply to them the penal sanctions provided by the law;
3. To put an end to all acts of harassment against all human rights defenders and humanitarian workers in Sri Lanka;
4. To conform with the provisions of the UN Declaration on Human Rights Defenders, adopted by the General Assembly of the United Nations on December 9, 1998, especially its Article 1, which states that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels", and Article 12.2, which provides that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
5. To ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights standards and international instruments ratified by the Democratic Socialist Republic of Sri Lanka.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), requests your urgent intervention in the following situation in Sri Lanka.

Brief description of the situation:

The Observatory has been informed by reliable sources about the assassination of Mr. Lasantha Wickrematunge, founder and Chief Editor of the Sunday Leader newspaper as well as a lawyer who was a vocal critic of corruption and abuse of authority in Sri Lanka as well as of the Government policies relating to the conflict.

According to the information received, on January 8, 2009, at approximately 10.45 am, Mr. Lasantha Wickrematunge was driving to work when he was shot by four unidentified gunmen riding motorcycles on the Attidiya Road, Ratmalana, Colombo, which is close to Ratmalana military base. He was rushed to the Kalubowila Teaching Hospital with serious head injuries, where he died at approximately 2.10 pm.

In the past, Mr. Lasantha Wickrematunge had been several times the target of intimidation attempts and lawsuits due to his investigative reporting on corruption and nepotism in the Sri Lankan Government and in society in general, and the impunity that accompanies them. Mr. Wickrematunge was also a critic of the war and advocated a negotiated political solution to the conflict.

The Observatory fears that Mr. Lasantha Wickrematunge's assassination is directly related to his activities as editor of the Sunday Leader and his vocal criticism of Government's policies relating to the conflict in Sri Lanka.

The Observatory expresses its deep concern about Mr. Lasantha Wickrematunge's assassination, which illustrates once more the situation of extreme insecurity faced by human rights defenders in Sri Lanka, and urges the Sri Lankan authorities to order an immediate, thorough and impartial investigation into his assassination, in order to identify all those responsible, bring them before a competent and impartial tribunal and apply to them the penal sanctions provided by the law.

Actions requested:
Please write to the authorities of Sri Lanka asking them to:

i. Guarantee in all circumstances the physical and psychological integrity of all Sri Lankan human rights defenders;
ii. Order a thorough and impartial investigation into the killing of Mr. Lasantha Wickrematunge, in order to identify all those responsible, bring them before a civil competent and impartial tribunal and apply to them the penal sanctions provided by the law;
iii. Put an end to all acts of harassment against all human rights defenders and humanitarian workers in Sri Lanka;
iv.
