No. 4105 スーダン:野党党首と政治局員が当局により恣意的に逮捕されました。

 SOSトーチャー国際事務局はスーダンにおける以下の状況に関して皆様の緊急の働きかけをお願いします。

<事件の概要>

 SOSトーチャー国際事務局はSOSトーチャーネットワークのメンバーであるスーダン反拷問機構(SOAT)より、野党人民会議党(PCP)の党首であるハッサン・アル・トゥラビ博士(76歳)と、PCPの政治局員であるバシル・アダム・ラハマ博士が恣意的に逮捕され、現在コベル刑務所に隔離拘禁されているという情報を受けました。

 情報によれば、アル・トゥラビ博士とアダム・ラハマ博士は2009年1月14日、首都ハルツームで、スーダン国家情報安全局の局員により逮捕されました。逮捕以降、二人には弁護士や家族との面会を許されていません。報告によれば二人は普段から高血圧症で、アル・トゥラビ博士の家族は薬を渡すことさえ許されていません。さらに、現在に至るまで、二人に対して嫌疑はかけられていないし、逮捕理由も明らかにされていません。

 同じ情報によれば、アル・トゥラビ博士は逮捕2日前に、スーダンのバシル大統領に対して、退去や村の焼き討ち、系統的なレイプなどダルフールで行われてきた犯罪に対して政治的責任をとるよう呼びかける声明を発表し、大統領は国際刑事裁判所(ICC)で裁かれるべきだと述べました。アダム・ラハマ博士もICCでの裁判を支持すると表明しました。

 SOSトーチャー国際事務局は、アル・トゥラビ博士とアダム・ラハマ博士の心身の安全について、とりわけ、二人が拷問あるいはその他の形態の虐待の危険性に直面していることに深い懸念を表明します。さらに情報によれば、二人は平和的に表現の自由を行使したことだけを理由に拘禁されていると思われ、国際事務局はその点についても懸念しています。国際事務局はスーダンに対して、市民的および政治的権利に関する国際規約の第9-1条が「何人も恣意的な逮捕あるいは拘束を受けてはならない」としていることを想起するよう呼びかけます。国際事務局は、国際刑事裁判所検事が審理前判事にアル・バシル大統領をジェノサイド、戦争犯罪、人道に対する犯罪の容疑で告訴するよう求めて以来、スーダンで強制的な検閲、恣意的拘禁および尋問が増加しているという情報を受けてきました。

<行動要請>

 スーダン関係当局に対して以下の内容の要請をお願いします。

1.いかなる情況にあろうとも、アル・トゥラビ博士とアダム・ラハマ博士の心身の安全を保障すること。

2.自ら選任する弁護士との接見、家族との面会および必要な医療手当てを即時無条件で受けられるよう保障すること。

3.国際法および国際基準に合致した正当な嫌疑が不在の中、彼らの即時釈放を命じること。もしそのような嫌疑が存在するならば、彼らを公平、独立、資格ある公正な裁判に付し、その間の手続き上の権利をすべて保障すること。

4.これら事件の責任者をすべて特定し、裁判に付し、法律に基づいて刑事あるいは行政罰を適用できるよう、徹底的で公平な調査を命じること。

5.国内法および国際人道法および国際人権基準に従って、国内全土における人権尊重と基本的自由を保障すること。とりわけ、スーダンの司法制度およびすべての法律を暫定的憲法および国際人権基準に沿って改革し、国家公務員の免責に終止符を打つことを急いで行うこと。

I am writing you to express my concern over the arbitrary arrest and detention of Dr. Hassan Al Turabi and Dr. Bashir Adam Rahama of the Popular Congress Party (PCP) on January 14, 2009. I would like to urge you the followings:

1. To guarantee, in all circumstances, the physical and psychological integrity of Dr. Hassan Al Turabi and Dr. Bashir Adam Rahama;
2. To guarantee immediate and unconditional access to a lawyer of their choice, their family and any appropriate medical care and treatment they may require;
3. To order their immediate release in the absence of valid legal charges that are consistent with international law and standards, and if such charges exist, bring them before an impartial, independent, competent and fair tribunal and guarantee their procedural rights at all times;
4. To order a thorough and impartial investigation into these events, in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
5. To guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international humanitarian law and human rights standards, and in particular, expedite reforms to bring the Sudanese justice system and all legislation into line with the Interim National Constitution and international human rights standards, and to end the impunity of state officials.

Arbitrary arrest/ Incommunicado detention/ Risk for safety
The International Secretariat of the World Organisation Against Torture (OMCT) requests your URGENT intervention in the following situation in Sudan.

Brief description of the situation

The International Secretariat of OMCT has been informed by the Sudan Organisation Against Torture (SOAT), a member of OMCT SOS-Torture Network, about the arbitrary and incommunicado detention of Dr. Hassan Al Turabi, 76-year-old leader of the opposition group Popular Congress Party (PCP), and Dr. Bashir Adam Rahama, political officer of the PCP, who are currently detained in Kober Prison.

According to the information received, Dr. Hassan Al Turabi and Dr. Bashir Adam Rahama were arrested by agents of the Sudanese National Intelligence and Security Services (NISS) on 14 January 2009 in Khartoum. Since then, they have been refused access to their families and legal representation. Both individuals reportedly suffer from high blood pressure and Dr. Hassan Al Turabi's family was not allowed to give him his medicine. Furthermore, till now, no charges were brought against them and the exact reasons of their arrest remain unclear.

According to the same information, Dr. Hassan Al Turabi had made a statement two days before his arrest calling on President Al Bashir to assume political responsibility for the crimes committed in Darfur, including displacement, burning of villages and systematic rapes, and had suggested that he should defend himself in the International Criminal Court (ICC). Dr. Bashir Adam Rahama had also reportedly expressed his support for the ICC.

The International Secretariat of OMCT is gravely concern for the safety of Dr. Hassan Al Turabi and Dr. Bashir Adam Rahama, being at particular risk of torture and other forms of ill-treatment due to their conditions of detention. OMCT is further concerned with regard to their detention, which, according to the information received, seemed to be based solely for the peaceful exercise of their rights to freedom of expression. OMCT recalls to Sudan that according to article 9 1) of the International Covenant on Civil and Political Rights (ICCPR) "no one shall be subjected to arbitrary arrest or detention". OMCT has been informed of an increase in incidents of enforced censorship, arbitrary detention and interrogation since the ICC Prosecutor asked the pre-trial judges to indict President Al-Bashir for genocide, war crimes and crimes against humanity.

Requested Action

Please write to the authorities in Sudan urging them to:

i. Guarantee, in all circumstances, the physical and psychological integrity of Dr. Hassan Al Turabi and Dr. Bashir Adam Rahama;
i. Guarantee immediate and unconditional access to a lawyer of their choice, their family and any appropriate medical care and treatment they may require;
ii. Order their immediate release in the absence of valid legal charges that are consistent with international law and standards, and if such charges exist, bring them before an impartial, independent, competent and fair tribunal and guarantee their procedural rights at all times;
iii. Order a thorough and impartial investigation into these events, in order to identify all those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
ii. Guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international humanitarian law and human rights standards, and in particular, expedite reforms to bring the Sudanese justice system and all legislation into line with the Interim National Constitution and international human rights standards, and to end the impunity of state officials.
