No.4107 キルギス:一人の青年が拷問によって窃盗の容疑で自白を強要されました。

 SOSトーチャー国際事務局はキルギスにおける以下の状況に関して、皆様の緊急の働きかけをお願いします。

<事件の概要>

 SOSトーチャー国際事務局はSOSトーチャー・ネットワークのメンバーであるキルギス人権委員会より、カラコル市の市民であるティンチェティクベク・ザキベコフさんが自白強要の目的で拷問およびその他の虐待を受けたという情報を受けました。今日現在も、ザキベコフさんイシクル地域病院の外傷外科に入院しており、拷問や虐待による頭蓋内膿瘍と脳震盪を患っているということです。

 ザキベコフさんの供述によれば、2008年11月6日にザキベコフさんがイシクル地域の検察局およびキルギス共和国オンブズマンに行った報告によれば、2008年11月4日一人の警察官が逮捕令状なしに彼の自宅に来て、無理やり車に乗せてジェティ・オグス警察署に連れて行きました。

 警察署でティンチェティクベク・ザキベコフさんは4人の警察官にひどく殴られました。そして、ゾンブラク村から1頭の馬を盗んだという自白を得るため拷問を受けました。しかしザキベコフさんは申し立てられている罪を認めませんでした。

 ザキベコフさんの供述によれば、彼は棒や拳骨で殴られ、椅子の脚で背中、脚、腰、頭を殴られたそうです。拷問の実行者たちは認めなければ背骨を折ると脅しました。また自白を強要するために、裸にされてレイプされるという心理的拷問も受けました。さらに、実行者たちは刑事訴追をしないと約束してザキベコフさんからお金を巻き上げようとしたということです。彼はその日に病院に搬送されました。

 同じ情報によれば、ザキベコフさんが申し立てている拷問と虐待についての調査はまだ始まっておらず、彼が窃盗に加わったという申し立てについての犯罪捜査もまだ始まっていません。

 SOSトーチャー国際事務局はティンチェティクベク・ザキベコフさんの心身の安全および申し立てられている拷問と虐待について強い関心をもっています。国際事務局はまた、拷問により引き出された供述が裁判で使用されることについて懸念を表明します。国際事務局はキルギスも締約国である市民的および政治的権利に関する国際規約の第7条、「何人も、拷問又は残虐な、非人道的な若しくは品位を傷つける取扱い若しくは刑罰を受けない」と、同じくキルギスが締約国である拷問等禁止条約の第15条、「締約国は、拷問によるものと認められるいかなる供述も、当該供述が行われた旨の事実についての、かつ、拷問の罪の被告人に不利な証拠とする場合を除くほか、訴訟手続における証拠としてはならないことを確保する」を想起します。さらに、同条約の第11条は、「締約国は、拷問が発生することを無くすため、尋問に係る規則、指示、方法及び慣行並びに自国の管轄の下にある領域内で逮捕され、抑留され又は拘禁される者の身体の拘束及び取扱いに係る措置についての体系的な検討を維持する」としています。国際事務局はキルギス当局に申し立てられている拷問の情況について徹底的で公正な調査を命じるよう要請します。

<行動要請>

1.ティンチェティクベク・ザキベコフさんの心身の安全を保障するために必要な措置をすべてとること。

2.拷問および虐待の申し立てについて、責任者を特定し、裁判に付し、法に基づき刑事あるいは行政
罰を適用できるよう、これら事件に徹底的で公正な調査を命じること。

3.適切な補償、医療およびリハビリテーションを含み、適切で効果的で迅速な賠償が被害者に行われるよう保障すること。

4.国際人権基準に沿って国内全土における人権尊重と基本的自由を保障すること。

3. To ensure that adequate, effective and prompt reparation, including adequate compensation, proper medical care and rehabilitation, is granted to the victim;?

Alleged torture and other forms of ill-treatment/ Fear of lack of an effective investigation
The International Secretariat of the World Organization Against Torture (OMCT) requests your URGENT intervention in the following situation in Kyrgyzstan.

Brief description of the situation

The International Secretariat of OMCT has been informed by the Kyrgyz Committee for Human Rights (KCHR), a member of OMCT SOS-Torture Network, about the alleged torture and other forms of ill-treatment inflicted upon Mr. Tynchtykbek Zhakypbekov, a citizen of Karakol, in order to extract a confession. To this date, Mr. Zhakypbekov is still hospitalised in the Traumatology Division of the Issyk-Kul regional hospital as he reportedly suffers a craniocerebral injury and a concussion due to the torture and other forms of ill-treatment.

According to the testimony Mr. Zhakypbekov reported on 6 November 2008 to the Office of the Public Prosecutor of Issyk-Kul area and the Ombudsman of the Kyrgyz Republic, on 4 November 2008, a police officer arrived to his home without warrant of arrest and violently forced him into a car driving him to the Jety-Oguz police station.

At the police station, Mr. Tynchtykbek Zhakypbekov was reportedly severely beaten by four officers. He was allegedly tortured to obtain a statement in which he had to confess that he was responsible for the theft of a horse from the village Zhonbulak. However, Mr. Zhakypbekov did not confess to this alleged crime.

According to Mr. Zhakypbekov's testimony, he was beaten with a stick, fists and a chair on his back, feet, hips and head. The perpetrators threatened the victim with breaking his backbone. Also moral pressure was used by threatening the victim with undressing and raping him to obtain his confession. Further, the perpetrators allegedly tried to extort money from Mr. Zhakypbekov promising him to then stop his criminal persecution. He was brought on that same day to the hospital.

According to the same information, no investigation has yet been launched into the allegations of torture and ill-treatment suffered by Mr. Zhakypbekov and the criminal investigation into his alleged participation in the theft remains open.

The International Secretariat of OMCT is gravely concerned for the physical and psychological integrity of Mr. Tynchtykbek Zhakypbekov and about the allegations of torture and ill-treatment.

OMCT wishes to express its concern over the use of statements obtained under torture as evidence in a court case. OMCT recalls that article 7 of the International Convention on Civil and Political Rights, to which Kyrgyzstan is a State Party, states that "[n]o one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment" and that article 15 of the Convention against Torture, to which Kyrgyzstan is also a State Party, requires that "[e]ach State Party shall ensure that any statement which is established to have been made as a result of torture shall not be invoked as evidence in any proceedings (…)". Furthermore, according to article 11 of the said Convention,? "Each State Party shall keep under systematic review interrogation rules, instructions, methods and practices as well as arrangements for the custody and treatment of persons subjected to any form of arrest, detention or imprisonment in any territory under its jurisdiction, with a view to preventing any cases of torture". OMCT urges the authorities of Kyrgyzstan to order a thorough and impartial investigation into the circumstances of the allegations of torture.

Action requested
Please write to the authorities in Kyrgyzstan urging them to:
i. Take all necessary measures to guarantee the physical and psychological integrity of Mr. Tynchtykbek Zhakypbekov;
ii. Order a thorough and impartial investigation into these events, notably the allegations of torture and ill-treatment, in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
iii. Ensure that adequate, effective and prompt reparation, including adequate compensation, proper medical care and rehabilitation, is granted to the victim;?
iv. Guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with international human rights standards.
