No.4117 トルコ:人権NGOのメンバーが当局より度重なる嫌がらせを受けています。

 「国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」はトルコにおける以下の状況に関して、皆様の引き続きの働きかけをお願いします。

<新情報>

 人権擁護家保護のための監視機構は人権協会(IHD)よりIHDアダナ支部支部長のエセム・アカムさんに対する最近の嫌がらせ行為について情報を受けました。

 情報によれば、2009年3月10日、エセム・アカムさんの自宅に捜索令状と拘束令状を持った警察軍の反テロ部隊に属する警官が私服で訪れました。しかし、その時エセム・アカムさんは自宅にいなかったため、逮捕を免れました。拘束令の期限はいつになっているのかは不明です。

 この嫌がらせ行為は、IHDが子どもの基本的な権利が侵害されているケースに関してこの間に抗議文を出してきた背景の中で行われたものです。

 監視機構はエセム・アカムさんに対する相次ぐ嫌がらせを懸念し、当局は2008年初め頃よりアカムさんを特別な標的としてきたことを想起します。

 したがって、監視機構は、トルコ当局に、拘束する正当な理由が不在の中、エセム・アカムさんに対して出した拘束令を取り消し、1998年12月9日に国連総会が採択した人権擁護家に関する国連宣言に基づき、彼およびIHDのメンバー、さらにはトルコの人権擁護家すべてに対するあらゆる種類の嫌がらせを止めるよう要請いたします。

 監視機構はトルコ当局に、人権擁護家に関する欧州評議会閣僚委員会の宣言に従い、「人権擁護家が活動しやすい環境を作り、彼らを保護、促進、尊重できるような効果的な措置をとり、彼らが効果的な救済を利用できるよう保障し、彼らに対する攻撃や嫌がらせを防ぐ措置をとる」よう促します。

 監視機構はさらに、全欧安保協力機構OSCEの参加国として、トルコは次の事項を確認していることを想起します:「人権擁護家に関する国連宣言は、国家に、人権擁護家が国内および国際レベルで人権および基本的自由の保護と実現を促してそれに向けて努力できる環境を提供するような法律および行政手続きを採択して実施する責任があることを明確にし」、「OSCE、関係機関および現場の活動、並びに参加国家による人権擁護家への特別な注意、支援および保護の必要性があることを認識していることを想起します。

<背景情報>

 2008年1月23日、エセム・アカムさんはアダナで逮捕され、「非合法組織のメンバーであり」「非合法組織の宣伝をした」として告発されました。これらの嫌疑は、2007年12月7日に人権・自由アダナ前線が、革命的人民解放党(DHKP-C)のメンバーと思われるケブセル・ミズラクさんの殺害(2007年12月10日にアンカラで起きた事件で警察の関与が疑われている)を非難するために開いた記者会見にエセム・アカムさんが出席したことと関連しています。記者会見の席では、超法規的殺害を非難し、そうした人権侵害事件を防止するよう警察に呼びかけた文書が読み上げられました。

 DHKP-Cのメンバーであると告発されたアカムさんは、7年半から15年の範囲での実刑判決を受ける可能性があります。

 エセム・アカムさんは、同じく2008年1月23日に逮捕された6人の反対派とともに、アダナのF型監獄に拘禁されていて、2009年3月25日アダナの第8重度刑事裁判所での公判を予定して、2008年6月28日に釈放されました。

<行動要請>

 トルコ関係当局に以下の内容の要請をお願いします。

1.いかなる情況にあろうとも、エセム・アカムさんおよびトルコの人権擁護家の心身の安全を保障すること。

2.責任者をすべて特定し、彼らを文民の資格ある公正な裁判に付し、法に基づき刑事罰を適用できるよう、上記に述べた脅しおよび威嚇行為について徹底的で公正な調査を命じること。

3.司法レベルを含み、エセム・アカムさんおよびトルコのすべての人権擁護家に対する嫌がらせ行為をすべて停止させること。

4.1998年12月9日国連総会が採択した人権擁護家に関する宣言の条文、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、「国家は、個別であれ他者との合同であれ、すべての人が、本宣言に記述されている権利の合法的行使の結果により受ける、暴力、脅迫、報復、事実上あるいは法律上の差別、圧力あるいはその他の恣意的行為から資格ある当局の保護を受けるよう保障するために、あらゆる必要な措置をとるものとする」とした第12条2項に従うこと。

5.さらには、トルコが批准した国際および地域人権文書に沿って、国内全土における人権尊重と基本的自由を保障すること。

To comply with the provisions of the UN Declaration on Human Rights Defenders, especially its Article 1, which states that "everyone has the right, individually and in association with others, to promote and to strive for the protection and realisation of human rights and fundamental freedoms at the national and international levels", as well as Article 12.2, which provides that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";

5. More generally, to ensure in all circumstances the respect for human rights and fundamental freedoms in accordance with international and regional human rights instruments ratified by Turkey.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), requests your urgent intervention in the following situation in Turkey.

New information:

The Observatory has been informed by the Human Rights Association (nsan Haklari Dernei - HD) about recent acts of harassment against Mr. Ethem Ackaln, President of the Adana branch of the HD.

According to the information received, on March 10, 2009, the home of Mr. Ethem Ackaln was raided by plain clothes policemen working with the Anti-Terror Unit of the Police Forces, who were in possession of a search warrant and a detention order against him. However, Mr. Ethem Ackaln was not arrested as he was outside his home at that moment. The terms of the detention order remain unknown.

This act of harassment comes in a context where HD has been issuing public reactions on cases of violations of the most fundamental rights of children.

The Observatory is concerned about the ongoing harassment against Mr. Ethem Ackaln, and recalls that the latter has been a privileged target of the authorities since the beginning of 2008 (see background information).

Accordingly, the Observatory calls upon Turkish authorities to cancel the detention order against Mr. Ethem Ackaln in the absence of any valid ground for such detention, and to put an end to all kinds of harassment against him, HD members, and other human rights defenders in Turkey, in accordance with the UN Declaration on Human Rights Defenders, adopted by the General Assembly on December 9, 1998.

The Observatory urges the Turkish authorities to also comply with the Declaration of the Committee of Ministers of the Council of Europe on Human Rights Defenders, so as to "create an environment conductive to human rights defenders, to take effective measures to protect, promote, and respect them, to ensure their access to effective remedies, to take action to prevent attacks and harassment against them".

The Observatory further recalls that as a Participating State of the Organisation for Security and Cooperation in Europe (OSCE), Turkey acknowledges that "the [...] UN Declaration on Human Rights Defenders [... places] a responsibility [...] on states to adopt and implement adequate legislation and administrative procedures that would provide for a conducive environment for human rights defenders to promote and strive for the protection and realization of human rights and fundamental freedoms at the national and international levels", and recognises "the need for particular attention, support and protection for human rights defenders by the OSCE, its Institutions and field operations, as well as by participating States"[1].

Background information

On January 23, 2008, Mr. Ethem Ackaln was arrested in Adana and accused of "being a member of an illegal organisation" (Article 314 of the Criminal Code, referring to Article 220/6 of the Criminal Code in Turkish Law n° 5237) and "propaganda for an illegal organisation" (Article 7/2 of Anti-Terror Law n° 3713). These charges are linked to Mr. Ackaln's participation in a press conference organised on December 17, 2007 by the Adana Front for Rights and Freedoms (Adana Haklar ve Ozgurlukler Cephesi) in order to denounce the assassination, probably by the police, on December 10, 2007, in Ankara, of Ms. Kevser Mzrak, supposed to be a member of the Revolutionary People's Liberation Party (Devrimci Halk Kurtulus Partisi - Cephesi - DHKP-C). During the press conference, a document denouncing extrajudicial executions and calling on the police forces to prevent such human rights violations had been read out.

Accused of being a member of DHKP-C, Mr. Ackaln might be sentenced to imprisonment ranging from 7,5 to 15 years.

After being detained in the F-type prison[2] in Adana, with six opponents also arrested on January 23, 2008, Mr. Ackaln was released on June 23, 2008, pending a hearing, rescheduled for March 25, 2009, before the 8th Heavy Penal Court in Adana.

Actions required:

Please write to the Turkish authorities, urging them to:

i. Guarantee in all circumstances the physical and psychological integrity of Mr. Ethem Ackaln and of all human rights defenders in Turkey;

ii. Order a thorough and impartial investigation into the above-mentioned threats and acts of intimidation, in order to identify all those responsible, bring them before a civil competent and impartial tribunal and apply to them the penal sanctions provided by the law;

iii. Put an end to all acts harassment, including at the judicial level, against Mr. Ethem Ackaln and all human rights defenders in Turkey;

iv.
