恣意的に取りさげられました。

 SOSトーチャー国際事務局は、フィリピンにおける下記の状況に関して皆様の引き続きの働きかけをお願いします。

<新情報>

 SOSトーチャー国際事務局は、SOSトーチャーのネットワークの一員であるフィリピン被拘禁者救援委員会(TFDP)より、第25歩兵大隊による攻撃の生存者の訴えが、2005年5月21日、検察官により解決されたという情報を受けました。しかし、事件を裁判所に提出する代わりに、この訴状の記録が、2005年6月15日、ミンダナオの軍事オンブスマン事務所に意見と承認のために移されました。

<これまでの経緯>

 2005年2月8日、フィリピン軍第25歩兵大隊の隊員がミンダナオ島の先住民族ブラーンを襲い、3人―フランシスコ・ブレーンさん(32)、パディラ・ブレーンさん(29)、プルメンシオ・ブレーンさん(28)を殺し、4人。―ロジェリオ・ブレーンさん(42)、リッキー・ブレーンさん(16)、リチャード・ブレーンさん(31)他一人に傷を負わせました

 TFDPが受けた情報によれば、ミンダナオ島ダバオ南州マタナオのバランガイ・コロンサバク、ラティルで、朝6時30分頃、フィリピン国軍第25歩兵大隊の隊員たちが自宅から3キロほど離れた川に魚を獲りにいったロジェリオ・ブレーンさんと息子のリッキーさんに向けて発砲しました。

 ブレーンさんによれば、兵士たちはいきなり遠くから発砲しました。一発目は彼の頭の後ろに当りましたが貫通はしませんでした。ブレーンさんは、M79で背後から撃たれたとき、4メートル吹き飛ばされたそうです。

 リッキーさんも銃で撃たれました。数分後、発砲が止み、ブレーンさんは死んだふりをしました。兵士たちは確認のためにブレーンさんのそばに来ましたが、微動だにしない彼を見て、死んだと思いました。その後、彼は、兵士たちが「こいつを新人民軍のメンバーに仕立てよう」と言うのを聞きました。

 兵士たちが物を食べるのに夢中になっていたため、ブレーンさんはゆっくり川岸まで這って移動し、草の下に身を隠しました。数分後、兵士たちはブレーンさんがいなくなったことに気づき、周囲を探しましたが、見つけることはできませんでした。仕方なく兵士たちはその場を去り、ブレーンさんは最初に発砲された場所に這って戻りました。

 情報によれば、リッキーさんは叔父のリチャード・ブレーンさんの所に急を告げるために走りました。リチャードさんは急いで助けに走りました。リチャードさんの3人の弟たちもその後を走りましたが、兵士たちに銃撃され、殺されました。

 2005年3月7日、生存者たちは家族と共に、ディゴスの州検察局に行き、殺人および殺人未遂を訴えました。

<行動要請>

 フィリピン関係当局に以下の内容の要請をお願いします。

  1. ロジェリオ・ブレーンさん、リッキー・ブレーンさん、リチャード・ブレーンさんの心身の安全を保障すること。
  2. 必要とする人すべてに、緊急に適正な医療が施されるよう、適切な当局に介入すること。
  3. 責任者を特定し、裁判に付し、法律に基づいて刑事および行政罰が適用されるようにするため、綿密で中立の調査を命じること。
  4. 被害者およびその家族に適切な補償が提供されるよう保障すること。
  5. 国内法および国際人権基準にしたがって、国内全体で人権尊重と基本的自由を保障すること。

I am writing you to express my concern at the report of killings and frustrated killings of people from Barangay Colonsabak, Matan-ao, Davao del Sur, by the attack of minitary officer of the 25th Infantry Battalion that took place on February 8, 2005.

I would like to urge you to ensure the physical and psychological integrity of Mr. Rogelio Bulane, Mr. Ricky Bulane, and Mr. Richard Bulane; to intervene with the proper authorities to ensure that adequate medical assistance is provided as a matter of urgency to all persons who require it; to order a thorough and impartial investigation into the circumstances of these events in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law; to guarantee that adequate reparation is provided to the victims and the families of the victims; and to guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.

Extra-judicial killings of indigenous peoples

The International Secretariat of OMCT requests your URGENT intervention in the following situation in the Philippines.

New Information

The International Secretariat of OMCT has been informed by the Task Force Detainees of the Philippines (TFDP), a member of the OMCT network, that the complaint lodged by the survivors of an attack by the 25th Infantry Battalion against members of this Battalion for murder and frustrated murder was resolved by the Prosecutor on 21 May, 2005 and found probable cause. But instead of filing the case in court, the records from this complaint were transferred to the Office of the Ombudsman for the Military for Mindanao on 15 June 2005 for comment and/or approval.

Brief reminder of the situation

On 8 February 2005, members of 25th Infantry Battalion of the Philippine Army killed three civilians, Mr. Francisco Bulane (32), Mr. Padilla Bulane (29) and Mr. Prumencio Bulane (28), and wounded four others, Mr. Rogelio Bulane (42), Mr. Ricky Bulane (16), and Mr. Richard Bulane (31), members of the indigenous group B'laans, in Mindanao, Philippines.

According to the information received by TFDP, at about 6.30 in the morning, in sitio Latil, Barangay Colonsabak, Matan-ao, Davao del Sur, Island of Mindanao, members of the 25th Infantry Battalion of the Philippine Army based in Sta. Cruz, Davao Del Sur, opened fire on Mr. Rogelio Bulane and his son Ricky who had gone to the river about 3km from their home to catch food.

According to Mr. Bulane, the soldiers fired at them from a distance without provocation. The first gun burst accordingly hit the back portion of his head but did not penetrate. Mr. Rogelio Bulane said he was thrown about 4m away when he was hit with an M-79 in the back portion of his body.

His son Ricky was also hit with bullets. After several minutes the gun burst stopped and Mr. Bulane pretended that he was already dead. The military officers came closer to him, but he did not move and the soldiers thought that he was already dead. He then reportedly overheard soldiers saying, "we will charge this person as member of New People's Army (NPA)".

When Mr. Rogelio Bulane sensed that the soldiers were busy eating, he slowly crawled to the riverbank where he covered himself with grass. After several minutes, the military noticed that he had disappeared and searched the area without success. The soldiers left the area after several minutes and Mr. Bulane crawled back to the place where he and his son had originally been shot.

According to the information received, Ricky ran to alert his uncle, Mr. Richard Bulane, who went to help Rogelio Bulane but was hit by bullets from the soldiers. Three brothers of Richard followed him and were killed by gunshots from the soldiers.

On 7 March 2005, the survivors together with their families lodged a complaint before the Provincial Prosecution office in Digos City for murder and frustrated murder.

Action requested

Please write to the authorities in the Philippines urging them to:

  1. Ensure the physical and psychological integrity of Mr. Rogelio Bulane, Mr. Ricky Bulane, and Mr. Richard Bulane;
  2. Intervene with the proper authorities to ensure that adequate medical assistance is provided as a matter of urgency to all persons who require it;
  3. Order a thorough and impartial investigation into the circumstances of these events in order to identify those responsible, bring them to trial and apply the penal and/or administrative sanctions as provided by law;
  4. Guarantee that adequate reparation is provided to the victims and the families of the victims;
  5. Guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
