人権NGOのメンバーが恣意的に逮捕されました。

 国際人権連盟」(FIDH)と「SOSトーチャー」の共同プロジェクトである「人権擁護家保護のための監視機構」は、ウズベキスタンにおける以下の状況に関して、皆様の働きかけをお願いします。

<事件の概要>

 人権擁護家のための監視機構は、人権NGOである「エズグリック」より、メンバーのアブドゥラスル・フダイナザロフさんが逮捕されたという情報を入手しました。

 入手した情報によると、2005年7月21日午後6時、エズグリックのタシケント州アングレン支部長のアブドゥラスル・フダイナザロフさんが、市検察局の刑事捜査の後、コラボグで逮捕されました。彼はイルホム・ゾキロフ警部から400米ドルをゆすりとった容疑で起訴されました。

 2005年7月、アングレン住民のジャホンギル・オルティクボエフさんがフダイナザロフさんに手紙を送り、彼と親戚2人が市場で売るために乳牛を数頭トラックで運んでいたところ、ゾキロフ警部に停車させられたと知らせました。その乳牛が盗まれたものであることを発見したゾキロフ警部は、400米ドルで窃盗の隠蔽に同意しました。オルティクボエフさんと共犯者は市場で牛を売った後、ゾキロフ警部にお金を渡しました。しかし後に彼らは窃盗で拘禁され、有罪となりました。オルティクボエフさんは手紙でエズグリックに支援を求めました。

 入手した情報によると、アブドゥラスル・フダイナザロフさんはオルティクボエフさんの手紙にエズグリックの手紙を添えて、ウズベキスタン検察と内務省タシケント州支局に送付しました。2005年7月14日、オハンガロンスキー地方検察局の捜査の結果、ゾキロフ警部の行為に違法性は認められないという結論に達したという報告を、フダイナザロフさんは口頭で受けました。彼は、捜査を続け、事件の当事者全員に話を聞くべきだと主張しました。2005年7月18日にジャホンギル・オルティクボエフさんと兄弟のトヒル・オルティクボエフさんにオハンガロンスキー地方検察局から電話があり、2人はこの書簡で述べられていることは事実だと確認しました。

 2005年7月21日、ゾキロフ警部がフダイナザロフさんの携帯に電話をかけ、オルティクボエフ兄弟にお金を返したいので、面会を仲介してもらえないかと頼みました。同じ日の午後5時にゾキロフ警部はフダイナザロフさんの自宅に来ました。フダイナザロフさんは2人で話ができるように車を出し、警部は前の座席に座りました。警部はオルティクボエフ兄弟に返すお金として200米ドルと5万ソム(ウズベク通貨)を持っており、残りのお金は後で返すつもりだと言いました。車で向かう途中、警部が水を買いたいのでスーパーに寄ってくれとフダイナザロフさんに頼みました。車を停めると警部が店に向かって走り出したので、フダイナザロフさんも後を追おうと車から出ました。その瞬間、警察の車が3台来て、到着した警官がフダイナザロフさんを逮捕しました。ゾキロフ警部は店から戻ってくると、金はフダイナザロフさんの車の中にあると言いました。警官らは200米ドルと5万スムを発見し、その様子をビデオに撮りました。フダイナザロフさんは内務省で拘禁されました。

 2005年7月24日、フダイナザロフさんはウズベキスタン刑法5章2部165条にもとづき、ゆすりで起訴され、現在、内務省で拘禁されています。彼の裁判の日程はまだ分かりません。

 さらに監視機構は、エズグリックのメンバーは他のウズベキスタンの人権擁護家同様、しばしば嫌がらせを受けていることを想起します。(監視機構のアピールUZB001/0505/OBS036OBS036.1OBS036.2を参照)

<行動要請>

 ウズベキスタン関係当局に以下の内容の要請をお願いします。

  1. いかなる情況にあろうとも、アブドゥラスル・フダイナザロフさんおよびウズベクの人権擁護家すべての心身の安全を保障すること。
  2. アブドゥラスル・フダイナザロフさんにかけられた嫌疑が取り下げられ、恣意的な拘束が解かれるよう、これら事件について独立で中立の調査を実施し、彼の訴訟上の権利を保障すること。
  3. 1998年12月9日に国連総会が採択した人権擁護家に関する宣言、とりわけ、「すべての人は、人権と基本的自由を国内および国際レベルで促進および保護する権利を、個別におよび集団的に所有する」とした第1条と、国家は、この宣言に掲げられた権利を正当に行使した結果としてのあらゆる暴力、脅迫、報復、事実上のあるいは法律上の敵意に満ちた差別、圧力、あるいはその他のあらゆる恣意的な行為に反対し、すべての者を、個々にまたは他の者と共同して、権限ある当局によって確実に保護するためのすべての必要な措置をとるべきである」とした第12条2項にしたがい、ウズベキスタンの人権擁護家に対するすべての嫌がらせと報復の行為を止めさせること。
  4. 世界人権宣言およびウズベキスタンを拘束するすべての国際人権文書にしたがうこと。

I am writing you to express my concern at the arrest of Mr. Abdurasul Hudainazarov, Chairman of the Angren municipal branch of Ezgulik, on July 21, 2005. I would like to urge you the followings:

  1. To guarantee in all circumstances the physical and psychological integrity of Mr. Abdurasul Hudainazarov and all Uzbek human rights defenders;
  2. To put an end to all acts of harassment and reprisals against human rights defenders in Uzbekistan in conformity with the Declaration on Human Rights Defenders, adopted by the United Nations' General Assembly on December 9, 1998, in particular its article 1, which states that "everyone has the right, individually or in association with others, to promote the protection and realisation of human rights and fundamental freedoms at the national and international levels", and its article 12.2, which states that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
  3. To conform with the provisions of the Universal Declaration on Human Rights, and with all other international human rights instruments binding Uzbekistan.

The Observatory for the Protection of Human Rights Defenders, a joint programme of the World Organisation Against Torture (OMCT) and the International Federation for Human Rights (FIDH), received new information about the situation in Uzbekistan.

Brief description of the situation:

The Observatory has been informed by the human rights NGO Ezgulik about the arrest of one of its members, Mr. Abdurasul Hudainazarov.

According to the information received, on July 21, 2005 at 6 p.m., Mr. Abdurasul Hudainazarov, Chairman of the Angren municipal branch of Ezgulik, Tashkent oblast, was arrested in Korabog, pursuant to a criminal investigation by the city's Prosecutor's office. He is charged with the extortion of 400 US dollars from Mr. Ilhom Zokirov, a police captain.

In July 2005, Mr. Jahongir Ortikboev, a resident of Angren, wrote to Mr. Hudainazarov and informed him that Captain Zokirov had stopped him along with two of his relatives while they were transporting several cows by truck to sell them at a local market. Mr. Zokirov found out that the cows had been stolen and agreed to receive 400 US dollars to cover the theft. Mr. Ortikboev and his accomplices gave Captain Zokirov the money after they had sold the cows at the market. However, they were subsequently detained for the theft and condemned. By his letter, Mr. Ortikboev asked for the assistance of Ezgulik.

According to the information received, Mr. Abdurasul Hudainazarov sent Mr. Ortikboev's letter together with a cover letter from Ezgulik to the Prosecutor's office of Uzbekistan and Tashkent oblast Department of Internal Affairs. On July 14, 2005, he was orally informed that the investigation led by the Ohangaronskiy Regional Prosecutor's Office into the actions of Captain Zokirov did not conclude that his actions were illegal. Mr. Hudainazarov insisted that the investigation continues and that they listen to all parties in the given case. On July 18, 2005, Mr. Jahongir Ortikboev and his brother Mr. Tohir Ortikboev received a call from the Ohangaronskiy Regional Prosecutor's Office and confirmed the facts contained in the letter.

On July 21, 2005, Captain Zokirov accordingly called Mr. Hudainazarov on his mobile phone and stated that he would give the money back to the Ortikbaev brothers and asked him to arrange a meeting with them. The same day at 5 p.m. Captain Zokirov went to Mr. Hudainazarov's house. Mr. Hudainazarov took his car so that they both could talk and Captain Zokirov sat on the front seat. He said that he had 200 US dollars and 50,000 Uzbek sums, which he intended to give to the Ortikboevs, and that he would give the rest later. On the way, Captain Zokirov asked Mr. Hudainazarov to stop at a grocery store to buy some water. After the car stopped, Mr. Zokirov ran to the store and Mr. Hudainazarov also got out of the car to go after him. At that moment, three cars from the police arrived and police officers arrested Mr. Hudainazarov. As Mr. Zokirov returned from the store he said that the money was in Mr. Hudainazarov's car. They found the 200 US dollars and 50,000 Uzbek sums, and they recorded it with a video camera. Mr. Hudainazarov was taken into custody to the Department of Internal Affairs.

On July 24, 2005, Mr. Hudainazarov was charged with extortion under article 165, part 2, section "V", of the Criminal Code of the Republic of Uzbekistan and is currently detained by the Ministry of Internal Affairs. The date of his trial is not known yet.

Moreover, the Observatory recalls that Ezgulik members, along with other human rights defenders in Uzbekistan, are often subjected to acts of harassment (See Observatory Urgent Appeals UZB 001/0505/OBS 036, OBS 036.1 and OBS 036.2).

Action requested:

Please write to the Uzbek authorities, urging them to:

  1. guarantee in all circumstances the physical and psychological integrity of Mr. Abdurasul Hudainazarov and all Uzbek human rights defenders;
  2. carry out an independent and impartial investigation into these events and guarantee Mr. Hudainazarov's procedural rights so that the charges against him be dropped and that he be released since his detention is arbitrary;
  3. put an end to all acts of harassment and reprisals against human rights defenders in Uzbekistan in conformity with the Declaration on Human Rights Defenders, adopted by the United Nations' General Assembly on December 9, 1998, in particular its article 1, which states that "everyone has the right, individually or in association with others, to promote the protection and realisation of human rights and fundamental freedoms at the national and international levels", and its article 12.2, which states that "the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually or in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration";
  4. more generally, conform with the provisions of the Universal Declaration on Human Rights, and with all other international human rights instruments binding Uzbekistan.
